AKVIS releases Coloriage 10 for Mac OS X
AKVIS has released AKVIS Coloriage 10, a new version of its photo colorization software for Mac OS X (10.6 and higher) and Windows. The upgrade offers variations of coloring, new print options, and other changes. comScore: Apple is the top smartphone manufacturer in July
comScore (www.comscore.com), which "measures the digital world," has reported its July data on key trends in the U.S. smartphone industry for July 2015. Apple ranked as the top smartphone manufacturer with 44.2 percent OEM [original equipment manufacturer] market share, while Google Android led as the #1 smartphone platform with 51.4 percent platform market share. Android ranked as the top smartphone platform in July with 51.4 percent market share (down from 52.2% in June), followed by Apple with 44.2 percent (up 1.1 percentage points from July). Microsoft had 2.9 percent, BlackBerry had 1.3 percent and Symbian had 0.1 percent. Approximately 191.4 million people in the U.S. owned smartphones (77.1 percent mobile market penetration) during the three months ending in July. Facebook ranked as the top smartphone app, reaching 73.3 percent of the app audience, followed by Facebook Messenger (59.5 percent), YouTube (59.3 percent) and Google Search (52 percent).

Judge says no to new Apple-Smartflash trial
A Texas federal judge has denied Apple a new trial in its fight against a Smartflash patent infringement lawsuit; however, he also upheld a decision to toss US$532.9 million in damages that were originally awarded to Smartflash, reports AppleInsider (http://tinyurl.com/nonsll5). U.S. District Judge Rodney Gilstrap nixed Apple's request on the basis that the jury's verdict was supported by adequate evidence and thus shouldn't be overturned, according to court documents (http://tinyurl.com/qdzm9px). He also defended the validity of the disputed patents, and dismissed an Apple allegation that the court made a mistake omitting a jury instruction about prior art. Over one million Apple Watches sold in China
Sales of the Apple Watch in China have exceeded 1.07 million total devices, according to a big data analysis by a Chinese company called TalkingData — as noted by BusinessInsider (http://tinyurl.com/qdxdsmb). TalkingData is a mobile app monitoring platform used by 80,000 apps, including China's chat app WeChat. WeChat has over one billion registered users, and 549 monthly active users.

Final approval granted to 'anti-poaching' lawsuit...
U.S. District Judge Lucy Koh in San Jose, California, has granted final approval to a $415 million settlement that ends a high profile lawsuit in which workers accused Apple, Google and two other Silicon Valley companies of conspiring to hold down salaries, reports Reuters (http://tinyurl.com/n9pv3k2). She had rejected an earlier settlement offer, saying it didn’t offer enough compensation to about 64,000 workers affected by the case. However, in March Koh said she was satisfied after the companies increased their earlier offer of $324.5 million. The lawsuit involved about 60,000 Silicon Valley workers who claimed that Apple, Google, Intel, and Adobe conspired to drive down wages by agreeing not to “poach” each other’s employees. The complaint sought restitution for lost compensation and treble damages for the anti-competitive employment practices of the aforementioned companies.

Apple, Samsung headed back to court in early 2016
The fourth jury trial between Apple and Samsung over alleged patent infringements is set for early 2016, according to The Recorder (http://tinyurl.com/ouur2ez). U.S. District Judge Lucy Koh has said that the revised damages will be determined by a jury trial in March or April 2016. Last month, Samsung moved to put its ongoing patent feud with Apple on hold while it presses its appeal to the Supreme Court. "The questions present issues of enormous importance to patent litigation and the scope of innovation, especially in high-technology industries," Samsung's legal team wrote. In May the U.S. Court of Appeals for the Federal Circuit adjusted Samsung’s US$930 million penalty, related to its patent infringement suit with Apple. The appeals court decision removed $382 million in damages, but $548 million still remained. Apple is planning to move its Germantown store (in the Memphis, Tennessee area) with a “next generation” design planned for the new location, reports the Memphis Daily News (http://tinyurl.com/pjx8st4). The Cupertino, California-basec company has applied for a $1.5 million building permit through the city-county Office of Construction Code Enforcement for a new storefront and interior renovation at 2031 West St., within the Shops of Saddle Creek South. Apple releases eighth beta of El Capitan for developers
Apple has made available the seventh beta of Mac OS X El Capitan to developers for testing purposes. It's available through the Software Update section of the Mac App Store and through the Apple Developer Center (https://developer.apple.com). The new beta focuses on performance enhancements not new features. OS X 10.11 El Capitan is currently available to both registered developers and public beta testers. Yoink for Mac OS X upgraded to version 3.1
Matthias Gansrigler has updated his drag and drop "helper" Mac app, Yoink, to version 3.1. Yoink is designed to simplify drag and drop between windows, spaces and (full screen) apps by providing a "shelf" where dragged files can be placed, to free the mouse for other actions like navigating. Version 3.1 sports a less cluttered interface, improved support for some apps (such as Mail and Photos), and reduced CPU usage. Yoink's window can now be resized or automatically adjusted in height based on the number of files in it. You can now quickly view files in a file-stack in the app by right-clicking onto it. Survey: Apple devices at work are a security threat
PC Advisor (http://tinyurl.com/navms3s) reports that a new survey by Dimensional Research (http://www.dimensionalresearch.com), commissioned by cyber-threat security company, Centrify Corp., has found that user-owned Apple devices are massive security threat to businesses. Of the 2249 US workers surveyed, 45 percent said they used at least one Apple device for work. Results showed the majority of devices (63 percent) were owned by the user as opposed to the company, and are used to access work email, corporate documents and business applications. The study also discovered that 59 percent of Macs are used to access confidential company information and 65 percent are used to access regulated customer information. What's more, 51 percent of iPhones in the workplace are used to gain access to business applications with 58 percent of iPads used for the same purpose. Android Wear for iOS is rolling out today. It allows you to pair your iPhone (iPhone 5, 5c, 5s, 6, or 6 Plus running iOS 8.2+) with an Android Wear watch. Betas 1 lead Ian Rogers leaves Apple
Apple Music and Beats 1 lead Ian Rogers has unexpectedly left Apple two months since the Apple Music launch, reports the Financial Times (http://tinyurl.com/pfujvst). The departure is unexpected. Rogers is reportedly leaving to work for a Europe-based company in an unrelated industry. Apple said this month that 11 million people had signed up for free trials of Apple Music in the first four weeks since its launch. Spotify claims 75M active users, and Pandora has about 80M.

Fusion 8 Public Beta is available for download
Blackmagic Design has announced the public beta of the free version of Fusion 8, visual effects and motion graphics software, is now available for download from the Blackmagic Design website (www.blackmagicdesign.com). It's official; Apple will hold a media event on Sept. 9
It's official. Apple will hold a media event on Wednesday, Sept. 9, 10 am (Pacific), at the Bill Graham Civic Auditorium in San Francisco. The media invitation came with the teaser: "Hey Siri, give us a hint." Apple will almost certainly announce new iPhones. Speculation also calls for the unveiling of the next generation Apple TV and perhaps new iPads. What's a bit unusual about the event is that it's being held in the Bill Graham Civic Auditorium instead of the Yerba Buena Center or Cupertino's Flint Center. Apparently, Apple is expecting a big presence as the Civic Auditorium seats 7,000 compared to 1,500 for the Yerba Center and 2,400 for the Flint Center.

Apple will hold a September event announcing new iPhones (and perhaps more) at the Bill Graham Civic Auditorium in San Francisco, reports Hoodline (http://tinyurl.com/o8clrwl). An unnamed "trusted source, who wished to remain anonymous due to the extreme privacy surrounding the event, has shown us documentation from event logistics indicating that Apple is renting the building through September 12th," the article adds. Apple is expected to announce new iPhones, an updated Apple TV, and perhaps new iPads sometime next month.

Haima Tech releases a Chinese Android emulator for Macs
Beijing's Haima Technology, a Chinese software developer, has released the first Chinese Android emulator for Macs, reports CCTime reported (as noted by BrightWire.com, a global investment newswire). The emulator lets users develop and test Android applications on Mac computers. (CCTime is a Chinese website that covers telecommunications-related news.)

Ex-TSMC employee found guilty of leaking tech secrets to Samsung
Taiwan Semiconductor Manufacturing Co. (TSMC), the world’s largest chip foundry, has won a lawsuit against a former employee who leaked secrets including 28-nm process technology to Samsung, reports the EE Times (http://tinyurl.com/osklm3r). Taiwan’s Supreme Court decided in favor of TSMC against Liang Mong-song, a former senior director of R&D at TSMC's Advanced Modules Technology Division. After leaving TSMC, Liang became Samsung's System LSI division chief technology officer. The tech leak may have helped Samsung catch up and surpass TSMC in leading-edge 14-nm FinFET chips that foundry customers such as Qualcomm and Apple are designing for next-generation mobile devices, says the EE Times. Samsung has declined to comment on the case.

Addonics unveils host adapter with up to 20 Gbps throughput
Addonics Technologies (www.addonics.com) today announced the 6G 4-port eSATA controller, a high performance host adapter that provides total throughput of up to 20 Gbps (20,000 Mbps) via single PCIe 4-lane slot. The Addonics’ controller supports any SATA hard drive, SSDs or optical drive. All drives appear as individual drives and can be configured to form a RAID group using the RAID utility of the operating system. By attaching four high performance SSDs, a high performance, large capacity storage system can be created by stripping the four drives using the OS RAID utility. The US$169 plug and play product is compatible with HDD, SSD, Optical Drives and Blu-Ray Drives. It can be installed into the PCI-Express 4 lanes slot (also fits into PCI-Express 8/16 Lane or the graphic card slot). It will fit just about any computing system with a standard full height slot. The controller is compatible with Mac OS X, Windows, Linux or any operating system with a built-in AHCI driver.

Judge denies request by 'patent troll' to relaunch...
US Magistrate Judge Paul Grewal has shut down a non-practicing entity, or "patent troll," seeking to relaunch suits against cellphone manufacturers Sony, Amazon, and Apple, among others, over 4G patents, reports MacNN (http://tinyurl.com/qhyh3e3). Patent aggregation company Acacia and subsidiary Adaptix has been denied further suits over new products launched by the companies using the same technology. The judge says it must be satisfied with existing lawsuit results and patent agreements in place. Adaptix sued Apple in 2013 for patent infringement. The company claimed the iPhone 5 and iPad mini infringed upon their 4G technology. (By the way, a "patent troll" is a company that licenses patents to win court rulings limiting product sales.)

Tim Cook awarded $58 million of Apple stock
Apple CEO Tim Cook has been awarded company stock with a market value close to US$58 million, according to an SEC filing, as noted by Cult of Mac (http://tinyurl.com/nqmc4bf). The award came with stipulations that Apple’s TSR performance had to be in the top third of S&P 500 companies. The company now ranks 46th, which meant Cook’s stock options were vested. If Apple had wound up in the middle of the S&P 500, Cook’s award would have been reduced to 50 percent, while a placement in the bottom third would have earned him nothing, notes Cult of Mac. Cook still has 4.76 million outstanding restricted AAPL stock units, which will vest in 2016 and 2021. An additional 1.68 million will vest in six annual installments beginning 2016.

German court denies uniqueness of Apple's 'swipe to...
The German Federal Court of Justice has canceled Apple's patent for the swipe movement to unlock iPhones and iPads. The court said the patent in question was not a new invention, reports German broadcaster Deutsche Welle (http://tinyurl.com/nzl6hfd). Judges in the Federal Court of Justice in Karlsruhe said Apple's European patent, which was applied for in 2006 and awarded in 2010, is not new and that a mobile phone from a Swedish company already displayed these characteristics before Apple's devices did. The Karlsruhe court thus maintained a decision passed by the German patents court, which Apple had pleaded against, declaring the European patent void within Germany. The German Federal Court is the country's highest authority which rules on patents cases. In May the U.S. Court of Appeals for the Federal Circuit adjusted Samsung’s US$930 million penalty, related to its patent infringement suit with Apple. IDC: tablet sales will continue to decline
According to a new forecast from the International Data Corporation (www.idc.com) tablet shipments, inclusive of 2-in-1 devices, are expected to decline -8.0% in 2015, representing a notable slowdown from IDC's previous forecast of -3.8%. Shipments are now expected to reach 212 million with the vast majority being pure slate tablets. The overall trajectory of the tablet market has not changed significantly over the past year and a half, but the 2-in-1 segment, also referred to as detachables, is starting to gain traction, says IDC. While the 2-in-1 form factor is not new, OEMs [original equipment manufacturers] are getting more serious about this market and as a result, the research group expects the 2-in-1 segment to grow 86.5% year over year in 2015 with 14.7 million units shipped. Apple updates Logic Pro X and MainStage
Apple has updated Logic Pro X — its software for writing, recording, editing and mixing your own music — to version 10.2. It now includes Alchemy, a sample-manipulation synthesizer. With it you can quickly find and shape sounds from the massive Alchemy library or create your own with a choice of synthesis engines and advanced morphing tools. You can also produce sounds with analog-modeled filters, multiple modulation sources, an integrated arpeggiator, and a broad range of effects. Apple has also updated MainStage, the live performance companion app for Logic Pro X, with Alchemy support. VMware ships WorkStation 12 and WorkStation 12 Pro
VMware (www.vmware.com) has updated WorkStation and Workstation Pro to version 12. On the most basic level, Workstation is to a PC what Fusion is to a Mac (see our separate article on the upgrade of VMware Fusion 8 being released). If you're a former Workstation user, you should note some naming changes. The former Workstation is now dubbed Workstation Pro. The app formerly known as Player Pro now goes by the moniker of Workstation Player. The change was done to reduce confusion. Workstation Pro is akin to what VMware is doing with Fusion Pro.
