'CNET': Justice Dept. unlikely to win ebook case...
A "CNET" analysis says the U.S. Justice Department's legal pursuit of Apple for alleged e-book price fixing "stretches the boundaries of antitrust law and is likely to end in defeat." "It's a harder case against Apple than the publishers," Geoffrey Manne, who teaches antitrust law at the Lewis and Clark Law School in Oregon and runs the International Center for Law and Economics, told "CNET." One reason lies in the Justice Department's 36-page complaint, which recounts how publishers met over breakfast in a London hotel -- but Apple wasn't represented, the article says. The Department of Justice "has a far better case against the publishers than Apple," Dominick Armentano, professor emeritus of economics at the University of Hartford and author of "Antitrust and Monopoly," told "CNET." Apple offers iTunes VIP discounts to iBook publishers
Apple is apparently offering discounts to at last some iBooks publishers as part of a new iTunes VIP program, reports "TUAW" (http://macte.ch/PrSPL). These discounts -- available via iTunes Connect -- appear to be exclusive to the iBooks program, the article adds. Discounts range from US$500 off the base Mac Pro down to $60 off the base Mac mini. The discount is for two computers, two iPods (which appear to include iPads, etc.) and one Apple TV, adds "TUAW." Designed for Apple developers, iTunes Connect is a suite of web-based tools that allow you to submit and manage your apps for distribution on the App Store and Mac App Store. In iTunes Connect you can check the status of your contracts, set up your tax and banking information, obtain sales and finance reports, request promotional codes, and manage users, apps, metadata, and your In-App Purchase catalog.

Apple beefs up security for purchasing online
In the past 24 hours, Apple has apparently started prompting iOS devices owners and those with Apple IDs within iTunes to make their accounts more secure, requiring them to pick three security questions and enter their answers when they download a new app, reports "The Next Web" (http://macte.ch/36gki). The company is also asking users to enter a backup email address, in order to better protect their device but also their account (which is tied to Apple’s Retail website and all of its media services). Once the user has entered their questions, answers and a backup email address, they are sent an email to verify the changes, reports "The Next Web."

Patent troll company sues Apple over smartphone gestures
Another day, another lawsuit. A "Texas shell company" dubbed Touchscreen Gestures is suing Apple and RIM for patent infringement regarding smartphone gestures such as dragging and double tapping, reports "paidContent.org" (http://macte.ch/uyDpn). The lawsuit was filed in East Texas. The patents were issued in 2007 to a Taiwanese maker of touchpad technology. A related suit accuses Samsung’s Galaxy tablet of violating the same patents. "It’s unclear how the patents made their way from Sentelic to the Texas court room," notes "paidContent.org." "The most likely explanation is that they were purchased by one of a growing number of professional 'patent trolls' -- firms that don’t make anything but amass patents in order to make a business of suing deep-pocketed companies like Apple."

Australian government could also sue Apple over ebook prices
The Australian Competition and Consumer Commission has urged local retailers with concerns about price-fixing in the electronic book publishing market to voice their concerns, as it considers its options following a US Justice Department lawsuit against Apple and five of the world’s largest book publishers, reports the "Financial Review" (http://macte.ch/m83Vk). The ACCC said it was unable to comment on the status of any ongoing investigations. However, it was aware of the latest developments in the US concerning e-book publishing and pricing, according to the "Financial Times." New Ivy Bridge processors to be unveiled April 23?
Intel will officially unveil its Ivy Bridge computer processors on April 23, according to "DigiTimes" (http://www.digitimes.com). If that's true, new MacBooks Airs, MacBook Pros (or will that be MacBook Pro Airs?) and iMacs soon. The Ivy Bridge family of processors is the first by Intel to incorporate their 3D Tri-Gate technology, reports the "EE TImes" (http://macte.ch/Yc9LY).  These smaller transistors, with their fin-like structure, allow for high volume manufacturing of power-efficient processors with increased processing power while simplifying the transition to smaller nodes, such as 14nm. Gartner: the Mac now has 10.6% of U.S. computer market
Apple is in third place among U.S. computer vendors with 10.6% of the market, according to the latest data from the Gartner research group (http://www.gartner.com). (And that's not including the iPad, which Gartner doesn't consider a computer, at least along the lines of a desktop and laptop.) Apple's market share grew 3.8% from the first quarter of 2011 to the first quarter of 2012, with sales going from 1,580,000 Q1 2011 to 1,640,814 in Q2 2012. Ahead of Apple in the U.S. were HP with 29% market share and Dell with 22.3%. HP experienced the strongest growth among the top five vendors in the U.S., as its shipments grew 6.6%, and its market share reached 29 percent in the quarter. Apple was the only other vendor among the top five to show growth in the quarter, as its shipments increased 3.8%. Worldwide, the Mac still hasn't cracked the top five. The leading computer vendors globally, as of Q1 2012, are HP (17.2% market share), Lenova (13.1%), Dell (11%), Acer (10.9) and Asus (6%).

ChangeWave: iPhone 4S demand still hot six months later
Six months after its release, the iPhone 4S is still hot. A new survey by the ChangeWave research group (http://www.changwave.com) says 56% of the respondents who plan to buy a smartphone in the next three months plan to buy an iPhone 4S. That's up two percentage points from the last survey, taken at the height of the holiday shopping season. Changewave Research Director Paul Carton says the 56% is the second highest the research group has ever recorded -- second only to a survey taken just before the iPhone 4S was launched last fall. The 4,413 consumers polled in ChangeWave Research's March survey aren't exactly a representative cross-section of the buying public, notes "Fortune" (http://tech.fortune.cnn.com). They're primarily American (87%) and almost all early-adopter types. But as ChangeWave members they do tend to indicate which way the technological wind is blowing, adds "Fortune."

ClickFox: Apple reigns in customer loyalty
ClickFox, a firm that analyzes behavior for more than 400 million consumer accounts, has announced the company's findings from its brand loyalty survey. April is customer loyalty month, and ClickFox's survey results shed light on what companies and industries consumers are most loyal to, as well as key drivers of brand loyalty. Twenty percent of respondents singled out Apple as the brand they can't live without, with Coca-Cola, Google and Amazon also topping the list. Additionally, consumers indicated that they are most loyal to food and beverage companies (58%) and technology and gadget providers (51%). Conversely, respondents are least loyal to health and fitness companies (44%) and wireless providers (43%). Apple against stricter lithium-battery shipment-by-air...
Apple reportedly opposes stricter regulations restricting lithium-battery shipments by air, leading the US Department of Transportation to seek comments on whether the rules should be aligned with those of the UN, reports "Macworld UK" (http://macte.ch/zFyhX). Samsung is also against the regulations. The reason for regulations regarding the aerial transportation of lithium-batteries is that they can spontaneously combust, the article adds. UN rules that go into effect Jan. 1, 2013, say pilots must be notified when lithium batteries are on a flight, shipments should be labelled as hazardous materials, and employees should have training in handling such cargo. The UN rules are supported by Airlines for America and the Rechargeable Battery Association, which, ironically, represents Apple and Samsung, as well as other companies.

Apple developing software to detect, remove Flashback malware
Apple is developing a tool to "detect and remove" a Trojan that's purportedly infected more than half a million Macs. In a support article (http://support.apple.com/kb/HT5244), Apple has this to say about Flashback malware: "A recent version of malicious software called Flashback exploits a security flaw in Java in order to install itself on Macs. Apple released a Java update on April 3, 2012 that fixes the Java security flaw for systems running OS X v10.7 and Mac OS X v10.6. By default, your Mac automatically checks for software updates every week, but you can change that setting in Software Update preferences. Federal Aviation Administration to allow increased iPad use
The U.S. Federal Aviation Administration is revving up iPad usage, according to an "AVWeb" report (http://macte.ch/ZakhM). The FAA currently has about 1,100 employees -- from pilots to lawyers -- using tablets, has future plans for an app store, and now plans to broadly expand the use of iPads within the agency, according to its tech group. "AVWeb" says the FAA currently allows employees to use iPads to read and send e-mail or documents, and doesn't allow the devices to be used to access FAA networks. However, he FAA's manager of Architecture and Applied Technology said that by 2014, the FAA plans to allow workers the choice to replace laptops with iPads. Analyst: demand for the new iPad remains strong
In a note to clients -- as reported by "AppleInsider" (http://www.appleinsider.com) -- Sterne Agree analyst Shaw Wu says demand for the new iPad remains strong, but production of the device has reportedly been limited by supply of Retina displays, as well as new practices at Foxconn that has resulted in employee hours being cut. Foxconn is the China facility that manufactures iPads and iPhones. Wu thinks the situation to improve over the coming quarters with more production lines and suppliers being added. Samsung is currently believed to be the primary supplier of Retina displays for the new iPad, notes "AppleInsider."

Micron announces mSATA solid state drive
Micron Technology has announced a new solid-state drive (SSD) that broadens Micron’s client product portfolio to serve the ultrabook category (and perhaps MacBook Airs?).  It's based on the architecture of Micron’s RealSSD C400 drives.   The C400 mSATA drive is designed to work in ultrathin, high-performance SSD-based systems and can also act as a cache drive in dual-drive systems. SSD-caching systems have both a hard-disk drive and a low-capacity SSD. Google is most popular tech company; Apple second
Eighty two percent of Americans express a favorable opinion of Google overall according to a Langer Research Associates poll produced for ABC. What's more, 53% express a “strongly” favorable opinion of the world’s leading search engine. Apple came in second in the poll. Seventy-four percent see Apple favorably. However, in addition to trailing Google by a relatively slim eight percentage points overall, it lags by a wider 16 points in strong devotees. Strategy Analytics: Apple App Store, Android Market grow slows
Despite a blockbuster first quarter at the end of 2011 in which the Kindle Fire added more than 15,000 apps, the Fire’s growth has slowed considerably, with just more than 6,000 apps added this quarter, according to a new report from Strategy Analytics (http://www.strategyanalytics.com). Apple's market cap briefly hits $600 billion
For a brief period Apple’s stock market capitalization rate hit the US$600 billion mark this Tuesday.  Apple is by far the largest stock by market capitalization in the world now, but the previous record was held by Microsoft. "Amazingly, that is only about 3% higher for Apple and we are talking about a company where the shares have rallied a whopping 58% since the start of 2012.," says "24/7 Wall Street" (http://macte.ch/PiJmi). "Microsoft is also up big this year so far, but its current market capitalization rate is 'only' $260 billion and that is less than half of the value of Apple now.  Exxon Mobil Corporation is the second largest company by market capitalization with a market cap of $390 million.  So Apple is worth 1.5-times the value of Exxon Mobil."

Gartner: tablet sales to reach 119 million units in 2012
Worldwide media tablet sales to end users are forecast to total 118.9 million units in 2012, a 98% increase from 2011 sales of 60 million units, according to Gartner (http://www.gartner.com). Jumptap: new iPad sales cranking but traffic smaller for now
In its newly released March MobileSTAT, Jumptap (http://www.jumptap.com), which specializes in targeted mobile advertising, revealed that while the new iPad has crushed sales expectations, traffic levels were small compared to prior device versions. According to iPad traffic on the Jumptap network of over 107 million monthly mobile users, new iPad use in the first six days after launch was heavy, but represented just a small percentage of overall iPad use that week. New iPad traffic represented .52% of total iPad network traffic on the day of launch, peaked at 2.28% by day three, and closed out the week at 1.92%. The original iPad and iPad 2, on the other hand, each maintained 45% or more of the total iPad traffic throughout the week. Apple hires Symantec exec to led its tax department
A recent SEC filing by Symantec shows Apple has hired its former Chief Accounting Officer Phillip Bullock to lead Apple’s tax department, reports "The Next Web" (http://macte.ch/lFZ1X). "Phillip A. Bullock, who was appointed as Symantec’s Chief Accounting Officer in September 2009, announced he will be leaving the Company to lead the tax department at Apple, Inc., and not due to any disagreement with the Company on any matters relating to the Company’s operations, policies or practices," says the SEC filing." Apple Cinema Display market leader in its category
According to new info from the NPD DisplaySearch group (http://www.displaysearch.com), Apple's 27-inch Thunderbolt Display and legacy Cinema Display are North American market leaders for LED LCD computer screens sized 24 inches and up, accounting for 26.2% of the market. Though Apple leads sales in that market segment, its position has fallen considerably from 2010, when the Apple Cinema Display accounted for 53.3 percent of LED LCD monitors 24 inches and up, notes "AppleInsider" (http://www.appleinsider.com). At one point, Apple offered Cinema Displays in 20-inch, 24-inch and 30-inch versions, but those were replaced by one 27-inch LED Cinema Display in 2010.

Four U.S. carriers to work on centralized database
Four major U.S. wireless carriers have reached an agreement with the Federal Communications Commission to work toward a centralized database to track and disable stolen mobile phones, reports "The Wall Street Journal" (http://macte.ch/WDWzO). The database, which the wireless companies will build and maintain, will be designed to track phones that are reported as lost or stolen and deny them voice and data service. The idea is to reduce crime by making it difficult or impossible to actually use a stolen device, reducing resale value, says the "WSJ." Presently, Verizon Communications and Sprint Nextel block phones that are reported stolen from being reactivated. AT&T and T-Mobile USA don't. All four have agreed to be part of the new database, per the "Journal."

ATTO Technology has announced the ThunderLink and ThunderStream families of Desklink devices representing the latest next generation, high-performance storage and network connectivity products for mobile devices, laptops and ultrabooks. Wacom rolls out Bamboo Stylus duo
Wacom (http://www.wacomc.com) has launched the Bamboo Stylus duo, a new dual-purpose stylus for the iPad and Android tablets. It combines a capacitive pen tip for on-screen input at one end of the Stylus with a premium ball-point ink pen at the opposite end for use on traditional paper. Wacom has also introduced Bamboo Paper, the free digital notebook app that recently passed the 2.5 million download mark on the iPad, for the Android market. Bamboo Paper allows users to create and share handwritten notes, doodles and sketches on their mobile devices. Available at Wacom’s eStore in mid-April, 2012, Bamboo Stylus duo is priced at US$39.95. Bamboo Paper for iPad and Android, will be available as a free download from Apple’s App Store and the Google Play Android market place respectively beginning in May.

Dalet broadens NLE integrations with Apple, others
Dalet Digital Media Systems (http://www.dalet.com) has announced more flexible and comprehensive integration support with several non-linear editing platforms. The Dalet Xtend module, originally created to facilitate a more fluid workflow between the Dalet Media Asset Management platform and Apple Final Cut Pro systems, is being expanded to include similar media and metadata exchange capabilities with Avid Media Composer, Avid NewsCutter, Adobe Premiere, and other NLEs. This interoperability is designed to increase productivity and collaboration for editing workgroups. Dalet Xtend for Avid will be demonstrated at NAB 2012 on the Dalet Stand. Dalet Xtend for Adobe Premiere will be available later this year.
