EU regulators to accept Apple offer in ebook pricing case
European Union regulators will apparently accept an offer by Apple and four publishers to end an antitrust probe into their e-book prices, "handing Amazon victory in a bid to sell online books cheaper than its rivals," reports "Reuters" (http://macte.ch/pVRd1), quoting two unnamed sources.
Apple and the publishers have offered to let retailers set their own prices or discounts for a period of two years, and also to suspend "most-favored nation" contracts for five years, the article adds. Such clauses bar publishers from making deals with rival retailers to sell e-books more cheaply than Apple.
Apple has been sued in Europe, the U.S. and Canada for collaborating with publishers to "fix" ebook prices. The iPhone’s share of quarterly global smartphone app downloads stood at 29% in the second quarter of 2012, significantly below the 47% attributed to Android smartphones, according to new data from ABI Research (www.abiresearch.com).
"The iPhone’s download share tends to see a lot of seasonal fluctuation, but over the past year or so it has stayed surprisingly resiliently between 30% and 37% of the total," says senior analyst Aapo Markkanen. "In our estimates the second quarter represented the first time the iPhone dipped below 30%. The iPhone 5 will most likely cause a second-half hike to the download count, but that may be of a rather temporary nature."

Em Software (http://emsoftware.com/) has released WordsFlow 1.0, an US$200 plug-in for Adobe InDesign that automatically merges changes in placed text or spreadsheet files into already-edited InDesign stories on update. It's compatible with Adobe InDesign CS5/5.5 and CS6 on Mac OS X (10.5.8 and higher) and Windows.
It doesn't require any special configuration or extra steps to work beyond installing the plug-in. When a Word (or any text) file or spreadsheet is placed, WordsFlow asks InDesign to keep a link to the file (normally controlled by global preferences).
When the placed file is updated (locally or in a shared-file situation), InDesign will notice that the link's source has changed, and allow update using the usual mechanisms. WordsFlow then kicks in, and, instead of replacing the placed story wholesale, merges the changes in the new file contents with all the existing changes to the current InDesign story.

The Belkin Car Charger for Lightning ($29.99) is an updated version of Belkin’s slim-profile car charger. The 10 watt, 2.1 amp device is available in black.

Court dismisses Apple-Motorola Mobility infringement case
A patent infringement case between Apple and Motorola Mobility was dismissed by a Wisconsin district court today just hours before the trial was due to begin, reports the "IDG News Service" (http://macte.ch/fKXau).
This is part of an ongoing battle between the two companies. Apple has alleged that Motorola infringes 24 of its patents (21 of them with Android-based phones, the remaining three with set-top boxes and DVRs), while Motorola previously asserted 18 patents against a variety of Apple products (mostly but not exclusively iPhone, iPad and iPod). Litigation between the two companies has taken place in several different federal courts.
In November 2010 Apple sued Motorola, alleging that the company's smartphone lineup and the operating software it uses infringe on the iPhone-maker's intellectual property. Apple sued over cancellation of man's online order
Another day, another lawsuit. Apple has been sued by a New Zealand man Apple over an online deal that he claims the company unfairly backed out on, reports "Macworld UK" (http://macte.ch/FU3Xi).
Adam Crouchley, an online marketing specialist, is taking Apple to the Disputes Tribunal in December, after ordering largely discounted products on Apple.com in October, only to have them cancelled due to a "problem with the price," the article adds. On Oct. 10 he saw that some Apple accessories on the company's website had been reduced from as much as US$89 to just 83 cents.
Crouchley says he "spent about $35 and got about $1600 worth of gear." After placing his order, he purportedly got a confirmation email saying that some products had already been shipped and others saying that his credit card had been charged for his purchases, notes "Macworld UK."

Apple pays only 1.9% on overseas profit for 2012
Apple has paid only 1.9% tax on its overseas profits during 2012, according "ZDNet" (http://macte.ch/OQbkD), quoting info from the Cupertino, California's latest 10-K filing with the U.S. Securities and Exchange Commission (SEC).
On non-U.S. profits of US$36.87 billion for the 2012 fiscal year ending September, Apple paid only $713 million in overseas tax. That's "only a fraction of what the company paid compared to corporation tax of 25% in the U.K., and around 35 percent in the United States," notes "ZDNet."
In the U.S. Apple paid $12.3 billion in federal taxes on profit generated in the U.S., and just under $1.1 billion in state taxes. Apple -- like other companies such as Starbucks, Amazon and Google -- often leave their profit-generated cash overseas because the repatriation costs would result in 35% taxes applied once the money is brought back to the U.S.
IDC: Apple's share of the tablet market slips to 50.4%
Worldwide tablet shipments totaled 27.8 million units in the third quarter of 2012 (3Q12), according to preliminary data from the "International Data Corporation Worldwide Quarterly Tablet Tracker." The tablet market grew 49.5% year-over-year in 3Q12 and 6.7% over the second quarter of 2012, according to the IDC research group (www.idc.com).
Android shipments, led by Samsung and Amazon, surged during the quarter, at the expense of Apple, which saw its share slip notably during the quarter, says Tom Mainelli, research director, Tablets at IDC.

A Mexican court has denied Apple's bid to continue selling devices named "iPhone" while it battles a trademark dispute with a Mexican telecommunications company called iFone, according to PhoneArena.com.
The decision results from a 2009 suit Apple filed, trying to stop the Mexican company from using the name "iFone." The Mexican company is also suing Apple for infringement, asking for 40 % of Apple's profits off iPhone sales, according to PhoneArena.

Apple updates Safari, iPhoto, Aperture
Apple has posted updates for its Safari, iPhoto and Aperture products. You can obtain the updates via the Mac App Store or the Software Update component of hte Mac OS X System Preferences app.
Safari 6.0.2 includes security updates. It's for Mac OS X 10.7.5 or higher.
iPhoto 9.4.2 is also for OS X 10.7.5 or higher. According to Apple the changes are:
° Photos now can be added to shared streams or My Photo Stream by dragging them to "Photo Stream" in the source list;
° Multiple email addresses can now be copied and pasted in the "Shared with" field for shared streams;
° When more than five subscribers "Like" a photo in a shared stream, their names are now displayed correctly;

While "Consumer Reports" tested more than 600 smart phones, tablets, TVs and more for its December Annual Electronics Issue, only 10 standout products made the short list for performance and innovation. The iPhone 5 is among them.

Larger display sets iPad mini apart from competitors
The iPad mini stands apart from competitive 7.x-inch media tablets with its larger display, which is intended to offer a user experience that is closer to full-sized tablets -- along with its use of the 4:3 aspect ratio, which makes it suitable to capitalize on the existing iPad ecosystem.
However, the mini display falls short of other comparable 7.x-in tablets in terms of its display resolution, according to the "IHS iSuppli Display Materials and Components Service" from information and analytics provider IHS (www.isuppli.com).

On Thursday Apple filed its 10-K filing (http://macte.ch/7FxgL) with the U.S. Securities and Exchange Commission (SEC) for the 2012 fiscal year. Here are some tidbits from the filing:
° Apple spent US$3.4 billion on research and development (R&D) in 2012. That's an increase of $1 billion from 2011.
° Apple has approximately 72,800 full-time employees and an additional 3,300 part-timers and contractors. About 42,400 of the total full-time equivalent employees worked in the retail segment.
° Apple's retail stores account for 12% of the company's net sales. That's down from 13% in 2011. Apple plans to open another 30-35 retail stores in 2013.

As Microsoft has introduced its latest operating system Windows 8 this week, including a new desktop rebrand dubbed "Metro," CouponCodes4u (www.CouponCodes4u.com), a coupon code website, has conducted an online poll of 2,135 U.S. citizens to discover whether or not people were completely won over by the new Microsoft product and if they'll be upgrading their computers and laptops to the latest operating system any time soon.
Respondents were originally asked what type of computer they owned, to which 51% said they owned a netbook, while 27% said they used a laptop and 13% said they still used a desktop computer. Only 9% of users said they owned more than one type of computer, such as a laptop and a desktop.

LeviSync is a new iPad dock for an iMac
LevTech (www.levisync.com) has introduced the US$179 LeviSync, a new way to sync and charge any full size iPad with an iMac. It's an iPad docking arm that mounts on the back of an Apple all-in-one desktop.
With an iPad positioned conveniently to one side of an iMac's large screen, suddenly the user has more screen real estate to make use of, according to the folks at LevTech. LeviSync allows iPad to be close at hand for displaying stock charts, music playlists, videos, movies, email, and whatever the user finds useful.
It has bead-blasted aluminum and power-coated steel construction. The LeviSync also provides extra utility to an iMac computer with a 4-port USB hub hidden away under its base.
Sonnet announces Laptop Sleeve Plus Screen Cleaner
Sonnet Technologies has released its US$19.95 2fit Laptop Sleeve plus Screen Protector (http://macte.ch/7CuQo) for the 13-inch MacBook Pro with Retina display computer. It's a form-fitting cover designed to help prevent damage to the computer's finish.

Sonnet's xMac mini now supports USB 3.0
Sonnet says its xMac mini Server, a combination PCI Express (PCIe) 2.0 expansion system and 1U rackmount enclosure for Mac mini computers with Thunderbolt ports, is now USB 3.0-compatible.
It connects to the Mac mini's Gigabit Ethernet, HDMI, and USB interfaces and extends them to panel-mounted connectors on the front and back of the unit. What's more, Sonnet will offer existing xMac mini Server customers an upgrade path with a replacement cable kit. Apparent has unveiled the US$149 Doxie One (www.getdoxie.com), a personal paper scanner for homes, families, and small businesses. It will ship late this month.
It features iPad sync via the Lightning connector on the latest iOS devices or 30-pin SD accessories. The Doxie One comes with the Doxie app for Mac OS and Windows, Dropbox and Evernote cloud integration, ABBYY OCR technology, and PDF delivery via iMessage. Ships in late November.

" Relative to the $329 price, Apple's $99 battery replacement program is very expensive. Apple has not stated whether the iPad Mini's battery has the same 1,000 cycles rating as the iPad or the 400 cycle (12-18 month) capacity of the iPhone."
PriceGrabber predicts an increase in online holiday shopping
With the holiday shopping season officially underway, PriceGrabber has released additional results of its second winter holiday shopping survey, revealing where consumers will shop for gifts this year.
When asked to select the ways they will shop this season, nearly all respondents indicated that they will do some online shopping from a computer. The number of consumers who plan to visit brick-and-mortar stores dropped by two percentage points to 46% compared to last year. Additionally, the survey results indicated that 16% of consumers will shop using a mobile device, compared with 13% last year. Conducted from Sept. 14 to Sept. 27, 2012, the survey includes responses from 2,469 U.S. online shopping consumers.

Analyst: Apple to sell up to 1.5 million iPad minis launch...
In a note to clients -- as reported by "AppleInsider" (www.appleinsider.com) -- Piper Jaffray analyst Gene Munster -- thinks Apple will sell up to 1.5 million iPad minis this weekend when it launches.
By some estimates that's a modest start, though the analyst thinks that's just the tip of the iceberg. Why the "soft" beginning?
There won't be any 4G LTE models available at launch. Those versions of the iPad mini are scheduled to launch later this month.
Munster also thinks the "newness" of the smaller iPad may put folks off at first. "Consumers will gradually realize the benefits of the smaller form factor, which will drive adoption, although it may not take form in lines for tomorrow's launch," he says.
Schiller to make another court appearance in Apple-Samsung...
Phil Schiller, Apple's senior vice president of Worldwide Product Marketing will have to provide further testimony to lawyers for Samsung as part of the appeal proceedings related to the never-ending patent infringement case,, a California court ordered Thursday -- as reported by the "IDG News Service" (http://macte.ch/Pk1W5).
The U.S. District Court for the Northern District of California has ordered both companies to make available a number of expert witnesses to lawyers for the other company for out-of-court depositions of "not more than three hours," and the short witness list includes Schiller.
Apple sought a clarification with the court on whether Schiller was eligible for a request from Samsung lawyers, notes the "IDG News Service." Apple argued that Schiller spoke at the trial as a fact witness, not an expert witness.
