iPhone 5 design raises the bar for smartphone design
In a DisplaySearch (www.displaysearch.com) report, the research group says that after the iPhone 5 launch, as Apple faces the challenge of meeting market demand, mobile brands are considering what the next generation of smartphone will be.
"Specifications of any individual components are not the key to a successful smartphone, but how they work together to achieve new levels of performance," says DisplaySearch. "The iPhone 5 shows that thinness, power efficiency, and advanced performance can coexist if the brand has very strong design capability and is partnered with top-tier component vendors."

Apple responds to Samsung's trail misconduct claim
Earlier this month Samsung accused the jury foreman in the Apple/Samsung Samsung trial of misconduct, arguing that Apple's US$1.049 billion win in a California court should be thrown out in favor of a new trial. Now Apple has filed its response (http://macte.ch/XME0N)with the court, saying that Samsung had its shot to investigate foreman Velvin Hogan during jury selection -- and that it's too late to complain now, reports "The Verge" (http://macte.ch/RNN7n).
One of the main issues is that during jury selection Hogan was asked if he'd been involved in any lawsuits. He did mention one, but failed to disclose a breach of contract case from 1993 between him and his former employer, Seagate -- and Samsung is the single largest direct shareholder of Seagate. So Samsung says he was biased against Apple.
In its response, Apple points out that Hogan told the court that he'd been employed by Seagate during jury selection, and that if Samsung had truly been concerned about potential Seagate...
Apple's Siri is being naughty in China
Siri, Apple's voice-activated personal assistant, is breaking Chinese law by listing Chinese escorts, according to "The Register" (http://macte.ch/dpAfi).
The article adds that it's "apparently" returning numerous dubious local listings for escort services, nightclubs and other entertainment venues when prompted by the commend: "I want to visit prostitutes." Siri has also been caught helping out local users in the People’s Republic with requests for pornographic content, according to "TechInAsia." Given that Apple strictly forbids pornographic and sexually explicit apps, it’s very odd that Siri includes this functionality at all, the article points out.
So far Chinese authorities haven't taken any action. But prostitution, though widespread, is illegal in China, so we'll see.

Backup Plus storage for Mac gets USB 3.0

Currently available through Amazon.com, the Seagate web site, and from Apple Stores in November, both Backup Plus Portable for Mac and Backup Plus Desktop for Mac drives will feature the new USB 3.0 interface, which is also compatible with earlier USB 2.0 ports. This new interface means faster transfer of data, so you can backup more quickly, up to 10x that of USB 2.0, via TimeMachine or simply transferring a file from a computer to external storage, according to the folks at Seagate.
SeagateBackup Plus hard drives were first introduced in June of this year. They're designed to work interchangeably with both Mac and Windows computers. Seagate says the Backup Plus products include a software feature that makes them the world’s first external hard drives to provide a way to back-up content from social networks, such as Facebook and Flickr.

Apple fans prefer black products over white
Eleven years after the release of the original iPod classic, a recent study by price comparison Idealo (www.idealo.co.uk) shows which color Apple device is the most popular among its online consumers. Does Apple’s vintage white still reign supreme?
Idealo looked at 22 different specifications of Apple’s iPad, iPhone, iPod touch and iPod classic models, which are currently offered in either black or white colors from the Apple Store. The European price comparison compared the amount of clicks each model has yielded over the first three quarters of 2012 across its price comparison platforms in Germany, France, UK, Italy and Austria.
According to the data, nearly 70% of Idealo users prefer an Apple device in black over white. If a click is interpreted as a vote, than Idealo’s survey represents around a quarter of a million votes over the first nine months of 2012 and an interesting insight into the online behavior of Apple’s online consumers.
While the overall click distribution is...
Apple starts work on Prineville, Oregon, data center
Apple has begun work on the first, US$68 million phase of its new Prineville, Oregon data center, clearing and flattening land for one of two, 338,000 square-foot buildings atop the bluff that overlooks town, reports "The Oregonian" (http://macte.ch/l37yR).
The total cost of the facility will likely run in the hundreds of millions or billions of dollars once it's outfitted with servers to run iCloud service, the article adds. Apple paid US$5.6 million in February to buy 160 acres from Crook County, and promptly set up a small, 10,000 square foot modular data center on the site.
The Prineville data center is located a quarter mile south of a Facebook server farm. Oregon's mild climate and relatively low power costs are part of the draw for such facilities.
Rural "enterprise zones" spare computers and other equipment from the property taxes that other businesses pay. The exemption could be worth several million dollars or more to Apple, depending on the size of its investment, notes...
Apple changing its iPhone strategy in India
Apple is changing the way it sells iPhones in India, where it has a small market share despite the fact the South Asian nation is among the fastest-growing wireless markets in the world, reports "India RealTime" (http://macte.ch/asVRI).
Apple doesn’t run branded retail stores in the countries because local regulations make that difficult. So far the company has sold the iPhone through Indian telecom providers, who bundle the phones with data services.
Now Apple will begin selling the iPhone through specialized distribution companies in an attempt to reach a wider audience, "especially Indians who live in thousands of smaller towns," says "India RealTime." The company has enlisted the local operations of Ingram Micro, a large U.S.-based distributor of technology, and Redington (India), a distributor with 12,000 smaller partners across India, the article adds. Redington confirmed to "India RealTime" that it's has added iPhones to the list of Apple products it's selling in India.
Apple to add two more China stores
Apple will add two more stores in China as it expands sales outlets for its produces in the world’s largest market for computers and smartphones, reports "Bloomberg" (http://macte.ch/jkIsd).
A new store will open Oct. 20 in Beijing’s Wangfujing area, Apple said in a posting on its Chinese-language website. The company will also unveil a store in the southern city of Shenzhen, the hub where iPhones and iPads are made by Foxconn Technology Group, Apple spokeswoman Carolyn Wu said.
Analyst: third quarter iPhone sales may be better than predicted
In a note to clients -- as reported by "CNET" (news.cnet.com) -- Piper Jaffray analyst Gene Munster iPhone sales in the third quarter probably won't break the bank, but they may be higher than anticipated, says Piper Jaffray analyst Gene Munster.
Based on the number of iPhones activated by Verizon last quarter, the analyst believes Apple's non-iPhone 5 sales were stronger than expected.
This week Verizon announced it had activated 3.1 million iPhones in the third quarter, up 15% from the prior quarter and higher than Piper Jaffray's estimate of 2.5 million. Of those, only 651,000 were for the iPhone 5.
Munster calls those numbers "a positive read for Apple." Though he expects Apple's non-iPhone 5 sales to decline 35% from a year-ago, he's predicting a drop of just 4% for total iPhone sales in the third quarter. As a result, the analyst is sticking with his forecast of 25 million iPhones sold during Apple's last fiscal quarter.
Analyst: 'iPad mini' to be 'competition's...
In a note to clients -- as reported by "AppleInsider" (www.appleinsider.com) -- Sterne Agree analyst Shaw Wu thinks the rumored "iPad mini" (expected to be officially announced next week) -- will be the "competition's worst nightmare."
He says those competitors are already struggling to compete against the US$399 iPad 2 and $499 iPad. Apple hitting an even lower price point will only expand its share of the tablet market, Wu says.
The analyst adds that the main question is whether Apple will "go for the kill" against competitors and accept lower margins to reach the $199 price point of its competitors, such as the Google Nexus 7 and Amazon Kindle Fire HD. He
doesn't feel Apple needs to hit the $199 price point and match Google and Amazon. Wu thinks Apple could sell its smaller iPad for around $350 and it would still be a success.

EPEAT defends ultrathin notebook verifications
Earlier this week it was reported (http://macte.ch/XbRVj) that the Electronic Product Environmental Assessment Tool (EPEAT) has verified Apple's Retina display MacBook Pro and latest MacBook Air models were among notebooks included on their registry of environmentally approved products.
Following some criticism of that decision, EPEAT has now posted a defense of its actions . You can read the entire thing at http://macte.ch/ctYX8 .
"With these new standards in place, and stakeholders preparing to update the PC/Display standards EPEAT is poised to keep the intended progress of standards development, application and verification, and revision going strong," the environmental group says. "We encourage critics of the system to push for their points of view in the standards development process -- where it counts."
Apple to buy Color Labs? No, just the talent
Yesterday it was reported (http://macte.ch/5myaC) that Apple plans to purchase Particle, which specializes in Web applications and marketing projects using HTML5 ; now "The Next Web" (http://macte.ch/3hYZb) says the Cupertino company also plans to buy Color Labs, a photo and video-sharing social network.
Color Labs is a start-up based in Palo Alto, California. Its main product is a social application for photos, called Color for Facebook that allows people to take photos in addition to viewing other photos also taken in the vicinity. The application groups photos based on a user's friends so that he or she is more likely to see those that are more relevant. The app also lets you batch-upload photos,
Why would Apple want Color Labs? "We would look to Color’s patents, which may include one for a file format that they were working on to record HD video. Color said that it had six patents pending at the time of its funding, including its 'elastic' social graph and patents related to GPS...

Apple loses UK appeal against ruling in Samsung battle
Apple has lost its appeal against a UK ruling that Samsung had not infringed its design rights, reports the "BBC" (http://macte.ch/uLl3m).
In July a judge at the High Court in London ruled in July that the look of Samsung's Galaxy Tab computers wasn't too similar to designs registered in connection with the iPad (actually, he said they weren't as "cool"). Apple was ordered to place a notice to that effect on its website and in various publications.
Apple, as you might expect, appealed. However, the "BBC" says the appeal judges decided not to overturn the decision on the basis that a related Apple design-rights battle in the German courts risked causing confusion in consumers' minds.
This is all part of the ongoing, global legal battle. Apple and Samsung have filed more than 30 lawsuits against each other across four continents. For example, Apple alleges that Samsung copied the slide-to-unlock technology of its iPhone and iPad devices.
Judge: Apple profit/margin info should be made public
Information about sales, profits and margins for specific Apple products should be made public, the judge hearing the company’s lawsuit against Samsung ruled on Wednesday, though a higher court’s decision could keep the data from ever being revealed, reports the "IDG News Service" (http://macte.ch/MJXg4).
Apple used the financial information in a motion to ask for damages above and beyond the US$1.05 billion award that a jury awarded it in August. The jury had found Samsung copied iPhones and other Apple devices in several of its products. However, Apple wants to keep the financial information under seal, saying it constitutes trade secrets, notes the "IDG News Service."
However, Judge Lucy Koh of the U.S. District Court for the Northern District of California says those figures should be publicly available. But she ruled that the information should not be unsealed before the U.S. Court of Appeals for the Ninth Circuit rules on an appeal by Apple. Both courts have stays in place until...

According to the latest research from Strategy Analytics (www.strategyanalytics.com), the number of smartphones in use worldwide surpassed the one billion unit mark for the first time ever in the third quarter of 2012. It has taken 16 years for the smartphone industry to reach this milestone.

Nokia remained a dominant force in smartphones for over a decade until the arrival of Apple’s iconic iPhone in 2007," says Scott Bicheno, Senior Analyst at Strategy Analytics. The iPhone revolutionized smartphone design and it catalyzed industry growth."
By the third quarter of 2011, the research group estimates there were 708 million smartphones in use worldwide. After a further year of soaring demand, the number of smartphones in use worldwide reached 1.038 billion units during the third quarter of 2012.
"We estimate 1-in-7 of the world’s population owned a smartphone in the third quarter of 2012," says Neil...

Apple to hold mini-conference to focus on the Lightning...
Apple plans to hold a conference in Shenzen, China for its "Made for iPod/iPhone/iPad" (MFI) program partners on Nov. 7-8, reports "TechCrunch" (www.techcrunch.com), quoting an unnamed "source close to Apple’s accessory manufacturing partner." The event will reportedly focus on guidelines for the new Lightning connector that debuted with the iPhone 5.
The article says the conferenced will be similar to the one held Dec. 7-9, 2011, when Apple expanded the MFI program to promote adoption of new AirPlay and Bluetooth standards. What's more, Apple will strictly regulate sales of Lightning connectors for MFI partners, and that the cost per part for those components, "while not unreasonable, is fairly high compared to other widely-available standards like USB," says "TechCrunch."

In a note to clients -- as reported by "AppleInsider" (www.appleinsider.com) -- Piper Jaffray analyst Gene Munster thinks the rumored "iPad mini" will have a cannibalization rate of 20%. In other words, every mini's sold would take the place of one full-size 9.7-inch iPad.
Assuming an iPad mini goes on sale Friday, Nov. 2 (Apple is expected to unveil it at an Oct. 23 media event), Munster forecasts Apple to sell at least five million units in the December quarter. That would be enough to cannibalize a million regular iPad units during the holiday shopping season, he says.
Previously, the analyst had forecast sales of 21 million iPads in the December quarter. However, with the expected launch of the iPad mini, he's increased his total iPad sales prediction to 25 million. For calendar year 2013, Munster's unit forecast has risen from 86.5 million to 95 million.
Foxconn: the iPhone 5 is darn hard to assemble
China-based Foxconn, which manufacturers products for Apple and other companies, says part of the problem with a shortage of iPhone 5, is that it's so darn complicated to assembly.
"The iPhone 5 is the most difficult device that Foxconn has ever assembled. To make it light and thin, the design is very complicated," an unnamed official told "The Wall Street Journal" (http://macte.ch/hMeHE). "It takes time to learn how to make this new device. Practice makes perfect. Our productivity has been improving day by day."
The executive said Hon Hai has taken steps to improve its productivity and address scratches on the metal casings of some new iPhones that were shipped. Hon Hai has recently implemented a new quality check procedure to reduce the chance of damages. However, the official told the "WSJ" that the iPhone 5 uses a new coating material that makes it more susceptible to scratching.
