Here are the latest updates for Mac OS X apps: AvisNocturna Software (www.avisnocturna.com) has announces Logoist 1.1, a major update to its advanced design application for Mac OS X. Law office files class action lawsuit against Audience
Another day, another lawsuit. The Law Offices of Todd M. Garber says a class action lawsuit has been filed in the Superior Court of California, County of Santa Clara, on behalf of a class consisting of all purchasers of the common stock of Audience pursuant and/or traceable to the company’s prospectus issued in connection with its May 10, initial public offering. Audience provides intelligent voice and audio solutions for mobile devices worldwide. The complaint alleges violations of the Securities Act of 1933 and further alleges that defendants’ public statements misrepresented and/or failed to disclose material adverse facts concerning the Company’s business, operations and prospects. Apple offered Bob Mansfield serious incentives to 'unretire...
When Bob Mansfield, Apple's senior vice president of Hardware Engineering, announced his impending retirement in June, Apple CEO Tim Cook faced an "insurrection" by "several senior engineers on Mansfield's team," according to "Bloomberg Businessweek" (http://macte.ch/HaMlS). Purportedly, the engineers felt that Mansfield's replacement, Dan Riccio, "was unprepared for the magnitude of the role," the article adds. So Cook approached Mansfield and offered him a package of cash and stock worth around US$2 million a month to stay on at Apple as an adviser and help manage the hardware engineering team, according to "Bloomberg Businessweek." Eye-Fi unveils 16GB wireless memory card
Eye-Fi (www.eye.fi) has announced a new Eye-Fi Pro X2 16GB, Class 10 card that increases both storage and speed capabilities while continuing to deliver wireless uploading of photos and videos from cameras. The new 16GB card (US$99) provides twice the storage capacity of the prior Pro X2 card, while the Class 10 performance delivers "ultra-fast read and write speeds," according to Eye-Fi CEO Yuval Koren. The new Pro X2, like Eye-Fi's other X2 series cards, enables you to wirelessly connect a camera to a mobile device, such as a smartphone or tablet, or use an authorized WiFi network to move content directly to a computer. Report: MacBook Air to capture 39% of slim notebook mark
Apple's MacBook Air is expected to have a global market share of 39% for "slim notebooks" in 2012 and the market share will slip to 28% in 2013 due to increasing sales of ultrabooks, reports "DigiTimes" (www.digitimes.com), quoting unnamed "Taiwan-based notebook supply chain makers" Shipments of MacBook Airs increased to 1.4-1.5 million units in September, the article says. "DigiTimes" predicts they'll reach an estimated 1.5 million units in October.

Samsung claims jury foreman was biased in Apple legal victory
Apple's billion-dollar trial victory over a patent dispute was tainted by the jury foreman’s failure to disclose a lawsuit and his personal bankruptcy, Samsung said in a request to a judge for the verdict to be thrown out, reports "Bloomberg" (http://macte.ch/0D0mt). Samsung said foreman Velvin Hogan was asked during jury selection whether he’d been involved in lawsuits and didn’t tell the judge that he had filed for bankruptcy in 1993 and had been sued by his former employer, Seagate Technology. Per "Bloomberg," Samsung has a “substantial strategic relationship” with Seagate and the lawyer who filed the complaint against Hogan is married to an attorney who works for the firm that represented Samsung in the trial against Apple, the Suwon, Samsung said in a Tuesday filing in federal court in San Jose, California. Apple working with Microlatch on NFC in iOS devices
Apple has made a deal with Microlatch (www.microlatch.com), a Australian biosecurity company that specializes in the design, development and manufacture of biometrics security within a stand-alone/self contained device, according to a report at "The Australian" (http://macte.ch/CWC8q). The partnership will purportedly allow Apple to develop fingerprint technology for use in NFC applications. NFC (Near Field Communication) is a short-range wireless connection technology that could turn the iPhone into an electronic wallet or security passkey. Onavo says the iOS Maps app is 'Maptastic'
The iOS 6 Maps app has been trashed by most folks, but Onavo (www.onavo.com) -- a privately held company backed by Magma Venture Partners, Sequoia Capital, Horizons Ventures and Motorola Mobility Ventures -- thinks it's "Maptastic." In light of the frenzy created by Apple Maps, Onavo took a look at something industry experts and iPhone users haven't yet considered: Is it possible that Apple Maps is actually better for iPhone users? Is the app more data efficient? Will using Apple Maps actually help users save their precious and limited megabytes, as well as being more responsive and faster to operate? 2012 sales predictions for ultrabooks cut in half
Amid high pricing and a lack of effective marketing to draw consumer’s attention away from other hot-selling mobile gadgets, global ultrabook shipments are falling short of expectations in 2012, prompting IHS (www.isuppli.com) to cut its near-term forecast for the next-generation notebooks. An estimated 10.3 million ultrabooks will ship worldwide in 2012, according to an "IHS iSuppli Compute Platforms Topical Report" from the information and analytics provider. This is down from the previous forecast issued earlier this year of 22 million units. In the newly adjusted forecast for 2012, more than half of the shipments for the year are expected to come in the fourth quarter. Meadows releases free QR code module for InDesign users
Meadows Publishing Solutions has released their 2D Bar Code Module for Adobe InDesign, with a free license option for producing QR Codes. This new software module is designed to generate QR Code, Data Matrix, and PDF417 two-dimensional bar codes directly in any Adobe InDesign document. Motorola Mobility withdraws ITC complaint against Apple
Google’s Motorola Mobility has withdrawn its second ITC complaint against Apple. It's an unexpected development. "The simplest explanation for a motion like the above would be a global settlement deal between the parties. But dismissals in such situation are usually with prejudice," writes Florian Mueller of "FOSS Patents" (www.fosspatents.com). "Also, note the passage [in Motorola Mobility's filing] saying that 'there are no agreements between Motorola and Apple, written or oral, express or implied, concerning the subject matter of this investigation.' The ITC has strict requirements that settlements must be disclosed to it in full detail. The ITC requires parties to make truthful representations in that regard." Report: tiered mobile data not inhibiting app downloads
New research from Parks Associates (www.parksassociates.com) shows tiered data plans pushed by carriers such as AT&T and Verizon aren't yet affecting consumer app use. According to "Primary Data Digest: Consumer Apps 1H12," which surveyed U.S. broadband households in the third quarter of 2012: ° Smartphone owners on tiered data plans have downloaded an average of 17 apps since purchasing their phones and use seven apps on average per month; ° Smartphone owners on unlimited data plans have downloaded an average of 16 apps since purchase and use six apps on a monthly basis. "Carriers like Verizon and AT&T are moving subscribers away from unlimited data plans at the same time phones are increasing their capabilities," says Jennifer Kent, research analyst, Parks Associates. "The iPhone 5, with its larger screen and LTE upgrade, will encourage people to use more data, but consumers are finding ways to compensate for data limits. Apple: don't use palm rests with Retina display MacBook Pro
Apple is warning people not to use palm rest covers with their MacBook Pro with Retina Display because they can cause the geometry of the device to shift when closed, and cause damage to the screen. On a support page -- as noted by "Macworld UK" (http://macte.ch/StvDK) -- Apple says: "To enable thin design, the clearance between the display and the palm rest area is engineered to tight tolerances. Do not use palm rest covers as the added thickness may interfere with the designed resting position of the display. ... As a best practice, keep the palm rest clear of any material."

CDT praises privacy changes in iOS 6
The Center for Democracy and Technology (CDT) -- a rights advocacy group -- says the privacy changes in iOS 6 give iOS device users substantially more control over their private data while setting the bar for others to follow, reports "Computerworld" (http://macte.ch/GPKMJ). "CDT applauds Apple's decision to incorporate these substantial pro-privacy elements into iOS 6, allowing users to finely control how their data gets shared with specific apps, and to more easily express a desire not to be tracked by marketers," the CDT said. Apple responds to HTC motion for a stay in legal battle
On Monday Apple replied to the latest motion for a Delaware stay in its legal battle with HTC. The requested stay involves over six patents that Apple asserted earlier this year in Florida. Apple's motion "implores the court to have mercy on Apple and to go ahead with at least the six patents at issue in this particular case," according to "FOSS Patents" (www.fosspatents.com). Apple's filing addresses HTC's case-specific arguments but mostly focuses on the broader picture. This is all part of an ongoing legal battle. In November 2010 Apple sued Motorola, alleging that the company's smartphone lineup and the operating software it uses infringe on the iPhone-maker's intellectual property. Analyst: iPhone 5 production improving
In a note to clients -- as reported by "The Mac Observer" (www.macobserver.com) -- Sterne Agree analyst Shaw Wu says that the demand for the iPhone 5 remains high and that production is improving. "Despite well-publicized concerns with its new Maps app, we have not picked up changes in supply chain build plans," he said. "Demand appears robust with its online store quoting a lead time of 3-4 weeks. In addition, we are seeing improving yields on in-cell touchscreens meaning it is becoming less of a constraint."

Apple to announcement fourth quarter financials Oct. 25
Apple will hold a conference call to discuss financial results of its fourth fiscal quarter on Thursday, Oct. 25, at 2 p.m. (Pacific). During last quarter’s call, Apple Chief Financial Officer Oppenheimer told analysts to expect revenue of US$34 billion for the fourth quarter, with earnings of $7.65 a share. Ban on Samsung's Galaxy Tab 10.1 lifted
Judge Lucy Koh has granted Samsung's request to dissolve the preliminary injunction against the Galaxy Tab 10.1, following a limited remand by the Court of Appeals for the Federal Circuit, reports "FOSS Patents" (www.fosspatents.com/). However, after a hearing scheduled for Dec.r 6, Apple can still win a permanent injunction over the D'889 tablet design patent if it prevails on the related part of its Rule 50 motion, the article adds. In related news, Samsung has filed an amendment to is lawsuit against Apple, adding the iPhone 5 to the list of allegedly infringing products that already includes the iPhone 4/4S, the iPad 2 and new iPad. This is all part of the ongoing, global legal battle. Apple and Samsung have filed more than 30 lawsuits against each other across four continents. For example, Apple alleges that Samsung copied the slide-to-unlock technology of its iPhone and iPad devices.

ABI Research: 'soft underbelly for Apple exposed'
Royalties raised from 4G cellular technologies in 2017 will be quadruple that of 2012, reaching over US$6 billion in 2017. This correlates with the growth of 4G devices and is dominated by handsets. Just as the market for 4G royalties is taking off, Apple is entering the 4G market in a bigger way with its LTE-enabled iPhone 5. After being on the offensive with design and software patents, Apple may have to defend itself, according to ABI Research (www.abiresearch.com). "Samsung, Apple’s prime target because of its market share, is strong in 4G patents and will look to use that against Apple," notes research director Phil Solis. "The only problem is that mobile technology patents for LTE are subject to FRAND rules." Sony has introduced its Extra Bass headphone series, available in headband-type and in ear bud versions. Verizon responds to iPhone 5/Wi-Fi concerns
Verizon has responded to concerns from customers about their iPhone 5 using data while connected to a Wi-Fi network, reports "The Loop" (www.loopinsight.com). "Under certain circumstances, iPhone 5 may use Verizon cellular data while the phone is connected to a Wi-Fi network," Verizon told "The Loop." "Apple has a fix that is being delivered to Verizon customers right on their iPhone 5. Verizon Wireless customers will not be charged for any unwarranted cellular data usage." The fix is available by going to Settings > General > About on the iPhone 5 and waiting for a message to appear. Then tap "Okay" to update.

Valpak integrates local coupons in Apple Passbook
Valpak Direct Marketing Systems (www.Valpak.com), which specializes in print and digital coupons, has enhanced its iOS app, enabling consumers to now add their favorite local coupons from Valpak to the new iOS 6 Passbook,. Passbook, announced by Apple last week, makes it easy for consumers to organize, manage and retrieve local coupons, loyalty cards, and other money-saving information from one place. With this new functionality, consumers will even be alerted with a reminder to use the coupon in their Passbook when they're in close proximity to the business, says Michael Vivio, president of Cox Target Media, provider of Valpak.  This feature will be available in the Valpak iOS app soon. Here are the latest updates for Mac OS X apps: Apple has revved Aperture, its photo software for pro users, to version 3.4.1. It's a maintenance release with some bug fixes. Apple's planned Internet radio service hits licensing...
Apple’s plans for an Internet radio service have hit a snag over the licensing of music controlled by Sony/ATV, which recently became the world’s biggest music publisher, reports "The New York Times" (http://macte.ch/a55gh). The two companies are at odds over what rate Apple should pay to stream Sony/ATV songs on its service, the article adds. Negotiations like this are new in the music industry. Half of all US adults get online via a smartphone or tablet
Half of all U.S. adults now have a mobile connection to the web through either a smartphone or tablet,, reports the Pew Research Center's (pewresearch.org) Project for Excellence in Journalism (PEJ) in collaboration with The Economist Group. Nearly a quarter of U.S. adults, 22%, now own a tablet device-double the number from a year earlier, according to the report. Another 3% of adults regularly use a tablet owned by someone else in their home. Nearly a quarter of those who don't have a tablet, 23%, plan to get one in the next six months. Even more U.S. adults (44%) have smartphones, according to the survey, up from 35% in May 2011. Ping disappears into the void
Apple has pulled the plug on Ping, the failed social networking service that Apple launched with iTunes 10 in 2010. It's now gone from iTunes. Ping was designed to let you post your thoughts and opinions, your favorite albums and songs, the music you’ve downloaded from iTunes, plus view concert listings and tell your friends which concerts you plan to attend. It lets you follow your favorite artists to see what they’re up to, check out photos and videos they’ve posted, see their tour dates and read comments about other artists and albums they’re listening to. Apple sued over Passbook feature in iOS6
Another day, another lawsuit. A company named Ameranth (www.ameranth.com) has sued Apple for patent infringement, according to "Patently Apple' (www.patentlyapple.com). The article says Apple is being sued on four counts related to the iOS Passbook ticketing system and linked to iCloud, the "Apple Notification Service", and Apple's Safari browser. Here's how Ameranth describes itself: "Ameranth, Inc. is a leading provider of wireless and Internet based solutions for the hospitality/gaming markets. NetMarketShare: Mac OS X, Safari up, iOS down
According to the latest market share survey from NetMarketShare (http://www.netmarketshare.com), the market share for Mac OS X, Safari and iOS all rose in September. According to the report, among desktop operating systems, Mac OS X had 7.16% of the global market share in September compared to 7.13% in August (that's global market share; in the US it's over 10%). That's an all time high for Mac OS X. Windows remains dominant with 91.73% as of September. That's down from 91.77% in August. When it comes to desktop/laptop browsers, Safari had 5.26% in September compared to 5.10% in August. Internet Explorer had 53.63%, Firefox had 20.08% and Chrome had 18.86%. That compares to, respectively, August percentages of 53.60%, 20.05% and 19.13%, respectively, for the browsers. Safari's all-time high is 5.43% in October 2011. Apple plans to open up retail stores in India -- IF ...
In a report for "The Economic Times," (http://macte.ch/nC8nK) Writankar Mukherjee & Chaitali Chakravarty say Apple has plans to open their own stores in India -- if the government eases up on local souring conditions. It might be easier for Apple to set up retail stores if the government allows its IT outsourcing operations in India to be included as part of the mandatory 30%, local sourcing requirement, the two executives told the publication. Under the rules, for a foreign retailer 30% supply needs to be sourced locally, notes "ZDNet" (http://macte.ch/nPI6W). The article says Apple India's current problem is selling their product through a reseller network. However, "ZDNet" notes that if the company wants to fix this by opening their own stores, they face another roadblock: having local inventory. European Commission turns up the heat on Apple
The European Commission has asked members to see if Apple is letting customers know about their right to a minimum two-year warranty, reports "Bloomberg" (http://macte.ch/sXW0w). Consumer groups in 11 countries claim the company has emphasized its after-care service over statutory protections. Only 4% of iOS 6 users were using Apple Maps after four days
Snappili (www.snappili.com), a mobile app company, says that its research shows that only 4% of iOS 6 users were still using Apple's homegrown Maps app four days after the operating system upgrade shipped. The company reports that: ° Before the upgrade to iOS 6, 25% of iOS users were viewing Google Maps at least once a day. ° Once they moved to iOS 6, the number of users using Apple Maps was 35%. ° Five days later that dropped to 4%. ° That number is still falling.
