Apple dominates smartphone revenues in the U.S.
The US mobile data market grew 3% quarter-over-quarter (Q/Q) and 17% year-over-year (Y/Y )to reach US$19.9 billion in the third quarter of 2012, according to a report published Monday by Chetan Sharma (www.chetansharma.com), an independent mobile analyst.
Apple dominates both the smartphone revenues and, "more importantly just crushes the competition on device profits," according to the research group. It has only 6% of the global unit shipment share but over 70% profit share.
"In tablets, Apple completely dominates the landscape in both shipments and revenue," says Chetan Sharma. "In fact, 95% of the profits in the tablet segment go to Apple with the remaining ecosystem fighting for the crumbs. Apple has the complete stronghold on the supply chain and has sucked out the oxygen from the OEM [original equipment manufacturer] world."
NPT sues Apple for patent infringement
Another day, another lawsuit. NovelPoint Tracking (NPT) has sued Apple for patent infringement. The Texas-based company claims Apple's various iDevices infringe on their patent for a method and apparatus for an automatic vehicle location, collision notification and synthetic voice, notes "Patently Apple" (www.patentlyapple.com).
Apple "isn't just being sued for their own iOS location based services but also for facilitating third party location based services on their iDevices," the article adds. The case was filed in the United States Texas Eastern District Court.
NPT appears to be a "patent troll" -- in other words, a company "who enforces patents against one or more alleged infringers in a manner considered aggressive or opportunistic with no intention to manufacture or market the patented invention." The company has also sued Ford Motor, RIM< HP, HTC, Track What Matters and other companies.

It's similar to Google's 20% time, which lets employees spend 20% of their time on side projects that could end up helping Google, according to "Business Insider" (http://macte.ch/hL1N1). Lessin says "Blue Sky" is a lot different than Google's approach, as it's limited to a small group of Apple employees.
However, she says it shows Apple's culture is changing gradually under CEO Tim Cook. "The hope is to keep Apple's employees at the company longer," says "Business Insider."

In October, as ordered by a U.K. judge, Apple updated its UK website saying that Samsung didn't infringe on its patented iPad design. Apple also included the judge's determination that Samsung devices are "not as cool," as well as three paragraphs of non-compliant text between the ordered material's two paragraphs.
The UK Court wasn't impressed and Apple was ordered to rewrite and repost the notice. The court also found Apple's compliance with the order regarding newspapers and magazines "lackadaisical at best."
This is all part of the ongoing, global legal battle. Apple and Samsung have filed more than 30 lawsuits against each other across four continents. For example, Apple...
Analyst: HTC settlement could net Apple $280 million annually
Apple and HTC have reached a global settlement (http://macte.ch/3eRO8) that includes the dismissal of all current lawsuits and a ten-year license agreement. The companies are releasing details, but in a note to clients -- as reported by "The MacObserver" (www.macobserver.com) -- Sterne Agree analyst Shaw Wu thinks the settlement could net Apple US$280 million per year.
"We believe Apple is likely getting a net licensing fee due to its much stronger patent portfolio and we think position as undisputed inventor of the modern smart phone with touchscreen," he said. The analyst bases his licensing fee estimate on discussions with his industry sources.
Wu estimates that HTC will ship between 30 million and 35 million Android-based smartphones in 2013. He adds that HTC's licensing payment "is apparently lower than the range that Apple initially proposed."
Samsung charging Apple more for mobile processors
Samsung has raised the price of mobile processor supplied to Apple by 20% recently, reports "MarketWatch" (http://macte.ch/Ru2mW), quoting an unnamed "person familiar with negotiations between the two tech giants."

According "MarketWatch," Apple buys all APs used for production of iPhone and iPad from Samsung with the volume estimated to be 130 million units last year and more than 200 million units this year. Samsung has a contract to supply APs to Apple until 2014, the report adds.
Apple, HTC settle patent dispute
Apple and HTC have reached a global settlement that includes the dismissal of all current lawsuits and a ten-year license agreement. The license extends to current and future patents held by both parties. The terms of the settlement are confidential.
"We are glad to have reached a settlement with HTC," Apple CEO Tim Cook said in a press release. "We will continue to stay laser focused on product innovation.”
"HTC is pleased to have resolved its dispute with Apple, so HTC can focus on innovation instead of litigation," adds HTC CEO Peter Chou.
In 2010 Apple filed a lawsuit against HTC for infringing on 20 Apple patents related to the iPhone's user interface, underlying architecture and hardware. The lawsuit was filed concurrently with the U.S. International Trade Commission (ITC) and in U.S. District Court in Delaware. HTC responded with counter-lawsuits.

In a note to clients -- as reported by "MacNN" (www.macnn.com) -- Needham & Company analyst Charlie Wolf says Apple Store revenues haven't kept pace with the growth in Apple's overall business, but that's because there are an increasing number of places to buy Apple products.
Over the past 10 years, Apple retail stores have grown sales at an average annual rate of 18% and Mac sales have managed an average of 12.2% annual growth,. Also, the retail stores continue to show strong growth despite the stagnant economy.
Wolf says same-store sales grew 5.4% in the fiscal fourth quarter, which was up from 3.2% in the June quarter. Non-Mac same-store revenues increased to 13.1% in the same period, up from 10.8% in June.
