Microsoft continues fight against Apple's trademarking of...
Microsoft has once again filed opposition to Apple's efforts to trademark the phrase "App Store," reports "CNET" (http://macte.ch/n3VJ3). In a new reply filed with the U.S. Patent and Trademark Office to get Apple's trademark application refused, Microsoft "rebutted Apple's rebuttal from earlier this month," the article adds.
"The undisputed facts establish that 'app store' means exactly what it says, a store offering apps, and is generic for the retail store services for which Apple seeks registration," the company wrote in the filing. "Apple does not contest that its other services are ancillary and incidental to its retail store services. Summary judgment should be entered denying Apple's application in its entirety."
In the nine-page document, Microsoft takes aim at Apple's defense of the trademark, which made use of testimony from Robert A. Leonard to show that "App Store" was in fact a proper noun and had proven itself to be tied to Apple ahead of competitors, says "CNET."

Analysts weigh in on Apple's size, rumored iPhone 5 delay
Two analysts have weighed in on Apple's stock, looking at the potential of Apple to grow and the effect of a rumored delay in the release of the iPhone 5.
Shaw Wu with Sterne Agee has initiated coverage of Apple with a Buy rating as part of a broad transfer of coverage from analyst Vijay Rakesh, reports "Barron's" (http://macte.ch/JKVG8). He says that investors still under-appreciate the growth in Apple’s end-markets, as well as its ability transform existing markets and create new ones.
“One of the key concerns that we and many investors have is that AAPL has gotten to a size where it is becoming difficult to grow the way it has over the past 10 years,” writes Wu. “We believe this is a legitimate concern but at the same time, if any company could do it, it would be AAPL," Wu tells clients. "We think the beauty with the AAPL story is that the company doesn’t need to win everyone over to continue its success. The company just needs to continue winning a fair share of its vast end...
Survey: iPhone poised for big success in China
A new survey by Morgan Stanley and AlphaWise -- as reported by "AppleInsider" (http://www.appleinsider.com) -- says that Apple is poised to capitalize on an explosion in sales of 3G smartphones in China, with the iPhone the most popular option, though lower prices could give it the lion's share of sales.
The survey results show 3G handsets and smartphones are taking off in China in 2011. Nearly 90% of respondents said they have "high interest" in buying a 3G handset or smartphone as their next phone.
Of those who plan to buy a smartphone, the most popular option is the iPhone. A total of 30% of respondents with 3G handset purchase intensions said they will most likely purchase an iPhone, followed by 25% for a Nokia device, 7% for HTC, 5% for Samsung, and 4% for Motorola.
The iPhone would be an even more popular option, the survey found, if Apple were to lower the price of its smartphone, notes "AppleInsider." With a cheaper option, Apple would command a 53% share of 3G phone buyers,...
SQL injection campaign infects some iTunes URLs
iTunes, reports "The Inquirer" (http://macte.ch/VOibq). Lizamoon is a SQL injection attack, where hackers target the database backend of a website and execute unauthorized commands by taking advantage of insecure code.
Insecurity firm Websense says that, according to a Google search, over 28,000 URLs have been compromised. It saw infected iTunes URLs that the media player will download from the publisher to update podcast and episode availability, says "The Inquirer."
"We believe that these RSS/XML feeds have been compromised with the injected code," says Websense security expert Patrik Runald. "The good thing is that iTunes encodes the script tags, which means that the script doesn't execute on the user's computer."

Earthquake in Japan may hurt Apple production
Apple's production of iPhones and iPads may be “meaningfully impaired” in the coming months in the aftermath of the earthquake and tsunami in Japan, according to Pacific Crest Securities, as reported by "Bloomberg" (http://macte.ch/KM9ut).
“If Apple is unable to find replacement supply of certain components, then iPhone and iPad production volume could be meaningfully impaired in the second half” of its fiscal third quarter, which ends in June, Andy Hargreaves, an analyst at Pacific Crest in Portland, Oregon, told clients.
The earthquake and tsunami earlier this month left Apple with as little as two months of inventory for key components for the iPhone and iPad tablet, Hargreaves said. Japan is a hub for consumer-electronics parts such as flash memory, which stores songs and photos in portable devices; batteries and touch-screen overlay glass that’s used in Apple products, IHS ISuppli said this month, as noted by "Bloomberg."

Apple heading toward $100 billion-plus annual revenue mark
Apple appears on target to top the US$100 billion annual revenue mark for the first time when it reports results for the fiscal year ending September 2011.
That puts the company "well ahead" of Microsoft and close to parity with IBM, while still trailing tech revenue leader Hewlett-Packard, which should top $130 billion in revenue for its October 2011 fiscal year, reports "Forbes" (http://macte.ch/ACTMs). The article adds that CLSA Asia-Pacific Markets analyst Steven Fox has upped his fiscal year 2011 earnings per share [EPS] forecast to $23, from $22.75, while boosting his FY 2012 view to $26.14, from $25.95.
“We think competition is scrambling and our iPad share assumptions are likely too conservative,” he writes, adding that he thinks Samsung has pushed out tablet launches in the US “to better respond to iPad2’s form factor, which we think further extends Apple’s first-mover advantage.” He adds that a proprietary survey finds “robust iPad uptake and purchase intentions.

"Our expectation going into the March 11th launch of the iPad 2 in the U.S. was that it would be successful, but probably more subdued than the launch of the original iPad a year ago," he wrote. "The launch blew out our expectations.
Meanwhile, Asymco (http://www.asymco.com)analyst Horace Dediu predicted that Apple’s current-generation iPhone 4 smartphone handset will likely sell around 60-65 million units in total. Sales of its future successor, the iPhone 5, could nearly double that amount, he said.

Nokia files second ITC complaint against Apple
Another day, another lawsuit. Nokia has filed a further complaint with the United States International Trade Commission (ITC) alleging that Apple infringes additional Nokia patents in virtually all of its mobile phones, portable music players, tablets and computers.
The seven Nokia patents in the new complaint relate to Nokia's technologies that Nokia claims are now being used by Apple "to create key features in its products in the areas of multi-tasking operating systems, data synchronization, positioning, call quality and the use of Bluetooth accessories."
This second ITC complaint follows the initial determination in Nokia's earlier ITC filing, announced by the ITC on Friday, March 25. Not surprisingly, Nokia doesn't agree with the ITC's initial determination that there was no violation of Section 337 in that complaint and is waiting to see the full details of the ruling before deciding on the next steps in that case.
In addition to the two ITC complaints, Nokia has filed cases on...

The upcoming version 6.4 of Adobe's DNG Converter will be the last to run on PowerPC Macs, Lightroom product manager Tom Hogarty writes in a blog post (http://macte.ch/GrO5G).
DNG Converter is a free, standalone application that's able to convert over 300 proprietary raw formats to the openly documented DNG file format. When a new proprietary raw file format is released, essentially every new camera model with raw capability, Adobe needs to update the DNG Converter so that it’s able to convert that proprietary format to the DNG format.
"The PowerPC(PPC) Mac systems, commonly referred to as G4 or G5 systems, represent a significantly different platform than the Intel-based solutions Apple started offering in January of 2006," writes Hogarty. "Due to the differences in software development environments, Photoshop CS5 and Lightroom 3 both dropped support for PowerPC systems in 2010. However, we’ve extended PowerPC support for the DNG Converter into 2011 in order to ensure that...

The transaction, which requires the approval of the Department of Justice and the Federal Communications Commission, and will likely spark a host of hearings in the U.S. Congress, would reverse nearly three decades of actions by the U.S. government and the courts that modernized and opened U.S. communications markets to competition, says Sprint. The wireless industry has sparked unprecedented levels of competition, innovation, job creation and investment for the American economy, all of which could be undone by this transaction, the company adds.
In a statement, Sprint said: "AT&T and Verizon are already by far the largest wireless providers. If approved, the proposed acquisition would create a combined company that would be almost three times the size of Sprint in terms of wireless revenue and would entrench AT...
