ITC judge: Apple didn't violate Samsung patents
Apple didn't violate patents owned by Samsung Electronics in making the iPod touch, iPhone and iPad, a judge at the International Trade Commission said in a preliminary ruling on Friday, as reported by "Reuters" (http://macte.ch/17F8M). ITC Judge James Gildea said on Friday that Apple didn't violate the four patents in the case. Samsung had accused Apple of infringement in a complaint filed in mid-2011. The full commission is due to decide whether to uphold or overturn its internal judge's decision in January, notes "Reuters." This is all part of the ongoing, global legal battle. Apple and Samsung have filed more than 30 lawsuits against each other across four continents. For example, Apple alleges that Samsung copied the slide-to-unlock technology of its iPhone and iPad devices.

MacBook Air leads ultra-portable computer sales
Despite Intel’s marketing campaign to educate audiences about the ultrabook computing platform, most consumers are not biting. Intel may have jinxed itself with a premature prediction that 40% of all notebook computers this year would be ultrabooks, according to ABI Research (www.abiresearch.com). Uptake of thin and light portable computers during the first half of 2012 was disappointing, though new data from the market intelligence firm forecasts 20 million will ship worldwide in 2012. Ultrabooks -- a term coined by Intel for ultra-portable computers based on its processor architecture -- are part of the broader portable computing market typically associated with the terms "laptop" or "notebook" computer. Targeted at mid-range prices, the most popular ultra-portable today is Apple’s MacBook Air. "Initial ultrabooks came to market several hundred dollars above consumer expectations," says senior practice director Jeff Orr. "High systems prices and waiting for the upcoming Windows 8...

A Verizon spokesman told The Verge that its version of the iPhone 5 won't able to handle simultaneous voice and data even if it connects to the carrier's LTE network. A Verizon spokesman told "The Verge" that its version of the iPhone 5 will not be able to handle the feature even if it connects to the carrier's LTE network. Ping to be killed Sept. 30
On Sept. 30, Apple will plug the plug on Ping, the failed social networking service that Apple launched with iTunes 10 in 2010. Ping was designed to let you post your thoughts and opinions, your favorite albums and songs, the music you’ve downloaded from iTunes, plus view concert listings and tell your friends which concerts you plan to attend. It lets you follow your favorite artists to see what they’re up to, check out photos and videos they’ve posted, see their tour dates and read comments about other artists and albums they’re listening to. You can also create a profile on iTunes to let your friends know who you’re following, what you’re listening to and which concerts you’re going to. It sounds better on paper than in reality. In fact, NPR named Ping one of the worst ideas of 2010. It said: "Why Ping has floundered can be summed up in a sentence: Apple doesn’t like sharing, thus, it is difficult for them to build a social network. "Riddle me this: How did the Apple crew create a...

Intel to software developers: embrace 'transparent...
At this week's Intel Developer Forum (IDF), Renée James, senior vice president and general manager of the Software and Services Group at Intel (www.intel.com) outlined her vision for transparent computing. This concept is made possible only through an "open" development ecosystem where software developers write code that will run across multiple environments and devices. This approach will lessen the financial and technical compromises developers make today. "With transparent computing, software developers no longer must choose one environment over another in order to maintain profitability and continue to innovate," says James. "Consumers and businesses are challenged with the multitude of wonderful, yet incompatible devices and environments available today. It’s not about just mobility, the cloud or the PC. What really matters is when all of these elements come together in a compelling and transparent cross-platform user experience that spans environments and hardware architectures...

German court deals Android system another blow
Germany: At the Munich I Regional Court, Presiding Judge Dr. Peter Guntz has announced his panel's decision, which had been pushed back by five weeks, on an "Apple v. Motorola Mobility" lawsuit over the "overscroll bounce", or "rubber-banding", patent. The accused Motorola Mobility tablets and smartphones were all found to infringe a patent for a "list scrolling and document translation, scaling, and rotation on a touch-screen display," reports "FOSS Patents" (www.fosspatents.com). Apple can now enforce a Germany-wide permanent (but appealable and, therefore, preliminarily-enforceable) injunction now by posting a 25 million bond (or making a deposit of the same amount), "which it undoubtedly will," the article adds. All this is part of an ongoing battle between the two companies. Apple has previously alleged that Motorola infringes 24 of its patents (21 of them with Android-based phones, the remaining three with set-top boxes and DVRs), while Motorola previously asserted 18 patents...

Ovum comments on iPhone 5's 4G capability in the UK
Following the announcement of Apple's iPhone 5 and its 4G capability in the UK, Matthew Howett, practice leader of Ovum’s regulatory telecoms team, has the following comments: "By supporting LTE using the frequencies that EE are deploying their 4G network over, EE will effectively have an initial  monopoly on sales of the iPhone 5 since customers will only fully benefit from its capabilities  if they take it though EE. The question will of course be how many non-EE customers will make the switch. Many will already be in contract with their existing provider, however with more than two years since the last major release (the iPhone 4), there could be a good number of people in the market for a new mobile provider. "For Vodafone and O2, who have spoken out against EE’s early 4G launch, this could well be what they were waiting for before launching a legal challenge to Ofcom’s decision. The regulator must be fairly confident of its position and has said will be ready to defend it. The...

ProjectLibre (http://www.projectlibre.org) has released ProjectLibre, an open source replacement of Microsoft Project. It has been downloaded the first week in 125 countries. ProjectLibre is designed to accelerate deployments worldwide. The initial goalwas to launch the ProjectLibre Project Server to produce a complementary server side solution that would replace Microsoft Project Server.  However, "we started down this road, but it was apparent the lack of updates over the years would be an issue for our ultimate mission," say the developers. ProjectLibre and the ProjectLibre Project Server can be extended as you have access to the source code for integration and customization. There are no more license fees for Microsoft Project Server, Microsoft Server, CALS, SQLServer and other proprietary licenses.

iPad use triggers 'unanticipated' Microsoft licensing...
A recent "Directions on Microsoft" survey (www.directionsonmicrosoft.com) of nearly 800 of its enterprise-size customers revealed that 67% already allow employees to use personal devices such as an iPad to access corporate IT infrastructure and assets, compared to only 33% that don't. For those companies that do grant access, the enabling architectures include direct access to Microsoft servers (25%), a remote desktop connection to a user's work PC (16%), a remote desktop session host (15%), and a virtual desktop infrastructure (10%). Unfortunately, allowing employees to access corporate networks with personal devices such as iPads is creating major headaches for software asset managers, particularly when it comes to Microsoft licensing compliance. Why? It triggers unanticipated and often expensive licensing requirements for Microsoft server applications, Office suites, and the Windows client OS. It can also impact the qualified device count that must be reported under Microsoft...
