AFPU sues Apple, others for 'false patent marketing'
Another day, another lawsuit. The Americans for Fair Patent Use (AFPU) has filed suit against Apple, Sprint Nextel, Verizon and Samsung Telecomms and accused the companies of false patent marking, reports "TechEye" (http://macosg.me/2/ji). The case was filed in a district court in Texas on Wednesday and alleges that the companies accused have falsely market numerous products with expired patents or patents that don't cover the market products with the intent to deceive the public. The AFPU wants monetary damages of $500 for each of the alleged violations of the statue, half of which will be paid to the US.

Senator writes Jobs about iPhone 4 problems
Democratic New York Senator Charles Schumer has written an open letter to Apple CEO Steve Jobs about the iPhone 4 antenna issues. He says the company's current solutions are "insufficient" and wants Apple to provide a free fix for consumers, reports "AppleInsider" (http://www.appleinsider.com). The U.S. senator said he wants Apple to explain in writing to consumers the true cause of poor reception with the iPhone 4 with regards to its antenna/reception problems. Schumer isn't happy with Apple's solutions so far, including an in-the-works software fix that will provide a cosmetic change on how signal bars are reported to the suggestion to buy a case to cover the handset's external metal antennas. He may be right. But it seems the senator is jumping on a controversial tech issue for a little free publicity. -- Dennis Sellers

Analyst says iPhone 4 design fix already in the works
Apple has “instituted a design fix” for the iPhone 4 that better insulates the phone’s transceiver module, according to Rodman & Renshaw analyst Ashok Kumar. "Barron's (http://macosg.me/2/jh) adds that the analyst is likely to offer free bumpers “as an intermediary solution.” Kumar says he's unclear if Apple will have a recall of the iPhone 4. The Sellers Research Firm (that's me) says no, it won't. In other matters, Kumar told clients that he expects shipments of 3.2 million iPads this fiscal quarter. He thinks sales of the Apple tablet are starting to eat into iPod sales, a trend will accelerate over time. -- Dennis Sellers

'Bloomberg': Apple antenna expert warned Jobs of...
Apple's senior antenna expert voiced concern to CEO Steve Jobs in the early design phase of the iPhone 4 that the antenna design could lead to dropped calls, reports "Bloomberg" (http://macosg.me/2/jg), quoting a "person familiar with the matter." Last year, Ruben Caballero, a senior engineer and antenna expert, informed Apple’s management the device’s design may hurt reception, the article says. A carrier partner also raised concerns about the antenna before the device’s June 24 release, "Bloomberg" adds, quoting "another person familiar with the situation." Apple is holding a press event tomorrow at at its Cupertino, California, headquarters. It's expected the company will address the reported antenna/reception problems with the iPhone 4.

REAL Studio to include Cocoa framework beta in upcoming release
REAL Software says their rapid application development tool, REAL Studio, will include the option to compile a Cocoa application in the upcoming 2010 Release 3.  REAL Software has been working on the development of the Cocoa framework for a long time and though it is not yet complete, it is far enough along that it will be made available as a beta to all REAL Studio users, according to Geoff Perlman, REAL Software Founder and CEO. 'DigiTimes': New, slimmer MacBook Air coming later...
"DigiTimes" (http://www.digitimes.com/news/a20100715PD208.html) says Apple is working on botha new MacBook Air and a new iPod touch. The article says the next MacBook Air will sport an 11.6-inch display and Intel Core ULV CPU. The machine will be released in the second half of this year and be built by Quanta computer, according to "DigiTimes." It will purportedly be even slimmer and lighter than the previous gen MacBook Air. As to the next iPod touch, "DigiTimes" says will feature a 3-megapixel camera, capable of both photo and video recording, and will adopt Apple's latest A4 processor, which is also used in the iPhone 4.

ShareTool update for Mac OS X offers more reliable VPN detection

Registration opens for 2011 International CES
The Consumer Electronics Association (CEA) says registration is open for the 2011 International CES, the world’s largest consumer technology tradeshow, scheduled for Jan. 6-9, 2011, in Las Vegas, Nevada. Registration for the 2011 International CES is free to industry professionals through Sept. 30. A registration fee of US$100 will go into effect starting Oct. 1, and the fee will be $200 effective 5:01 p.m. (Eastern) Dec. 31. Hotel room rates in Las Vegas, currently at some of the lowest rates in years, are available through a special block set aside for CES registrants. Attendees, exhibitors and media can register at http://www.CESweb.org . e-Node has announced CalendarSet 3.6 (http://www.e-node.net/cs), an update of the tool for implementing calendars on 4th Dimension forms. The new versioin fixes various bugs, simplifies the license system and brings an overall better stability. 
 Version 3.5 licenses can be upgraded to 3.6 for free (except original equipment licenses subscribed with a third party). Contact e-Node with a valid proof of purchase if your license was purchased from a third party. 
 CalendarSet 3.6 requires 4D 2004 or higher, including 4D 11 SQL. Only one registration key is required. The key is either linked to the 4D or4D Server serial number, or to the name of the company/developer. 
 Like all e-Node plug-ins, CalendarSet offers six different license types. There are no such things as MacOS vs Windows or Development vs Deployment.

Gartner, no, Apple has 9.8% of US market share
The IDC research group's latest data says Apple had 8.8% of the US computer market in the second quarter of 2010. But the Gartner research group has the number at 9.8%. Gartner says Apple shipped 1.79 million Macs during the quarter, compared to 14 million in the second quarter of 2009. In the year-ago period, Apple had, per Gartner, 9.1% of the computer market, so has seen annual growth of 24.7%. Gartner, like IDC, lists Apple as fourth among US computer vendors. Ahead of it, by market share, are HP (25.7%), Dell (23.7%) and Acer (11.3%). Worldwide computer shipments reached 82.9 million units in the second quarter of 2010, a 20.7% increase from the second quarter of 2009, according to preliminary results by Gartner. IDC: Apple has 8.8% of US computer market
Despite rising worries over sovereign debt and the pace of economic recovery, the global computer market grew 22.4% in the second quarter of 2010 (2Q10), in-line with forecasted growth of 22.9%, according to the International Data Corporation (IDC) Worldwide Quarterly PC Tracker. Apple now has 8.8% of the US market, up from 8.6% in the second quarter of 2009, according to IDC. That's 15.4% year-over-year growth. Apple is number four among US computer vendors. Ahead of it -- and their market shares -- are HP (25.7%) and Dell (24%). Apple has released iOS SDK and iOS 4.1 beta for its developers. They're available from the iPhone Dev Center. Apps built with iOS SDK 4.1 beta should only be tested on devices running iOS 4.1. Apple says to make sure to read the Xcode 3.2.4 Readme  (http://macosg.me/2/j8) and the iOS SDK 4.1 beta Release Notes  (http://macosg.me/2/j9) before installing and downloading these new releases. iOS is the operating system formerly known as the iPhone OS.

Microsoft paying developers to build mobile apps
Microsoft is paying developers to build mobile applications for its Windows Phone 7 system to help it narrow a lead by rival products from Apple and Google, reports "Bloomberg" (http://macosg.me/2/j7). The company is providing financial incentives ranging from free tools and test handsets to funds for software development and marketing, said Todd Brix, a senior director at Microsoft who works with app developers. In some cases, Microsoft is providing revenue guarantees, and will make up the difference if apps don’t sell as well as expected, he told "Bloomberg."

BatchOutput Server for InDesign gets support for commercial...
Zevrix Solutions has updated BatchOutput Server (http://zevrix.com/BatchOutputServer.php), an output workflow automation solution for Adobe InDesign, to version 4.5. The new version adds support for commercial printer workflows, book processing and more. Under BatchOutput Server workflow, production artists and prepress operators simply submit files to hotfolders that reside on the network. BatchOutput Server automatically outputs the files from its dedicated station using hotfolder settings, and will auto-activate document fonts as well. BatchOutput 4.5 can be purchased from the Zevrix Solutions web site for US$699.95, as well as from authorized resellers. A demo is available for download. The iPod is still alive and doing well
Don't write the iPod off just yet. While some have predicted its demise due to the rising popularity of the iPhone and iPad, the iPod is alive and thriving. In the US in May, the iPod line-up accounted for 73% of the MP3 player market, according to new research by the NDP Group (http://www.npdgroup.com). That's pretty much the percentage the line has had for, well, years. If you want to predict a product's demise, begin planning the funeral service of Microsoft's Zune. According to NPD, it held just 1% of the US market share in May.

Analyst says 'Consumer Reports' test of the iPhone 4...
Bob Egan, a technology blogger and global head of research/chief analyst at the TowerGroup, says the "Consumer Reports" on the antenna/reception problems of the iPhone 4 -- which left the publication unable to recommend the smartphone -- is flawed and "can barely be counted as scientific." Egan says "Consumer Reports" replicated the same uncontrolled, unscientific experiments that other sites have done. He also wonders if the issue is even entirely Apple's, supposing that AT&T could share some of the blame for the signal variance and call dropping problems. The Goldman Sachs research group says the iPad is going to put the hurt -- big time -- on netbooks. The NPD Group (http://www.npdgroup.com), a market research company, recently surveyed iTunes, iPod, iPhone, and iPod Touch users to explore their reactions to various music subscription-model concepts. According to NPD’s “iTunes Usage Report,” more than a quarter of respondents expressed strong interest in a free cloud-based music option, and many were willing to pay a subscription fee to access their own music libraries from multiple devices and platforms. Apple buys Poly9, which makes web mapping technology
Apple has bought Poly9 (http://www.poly9.com), a Quebec company, for its web mapping technology, according to a "LeSoleil" report (http://macosg.me/2/iu). The article gives no purchase price or acquisition date, but says that most Poly9 employees have moved to Apple's California headquarters. Poly9 -- whose web site is down -- is best known for developing web-based mapping programs and application programming interfaces for a variety of clients. Among its products is Poly9 Globe, a "cross-browser, cross-platform 3D globe which does not require any download." The interactive software allows users to spin a three-dimensional rendering of the Earth, while providing real-time statistics on the user's virtual location, including altitude. Analyst: iPhone 4 recall would cost Apple $1.5 billion
If -- and it's not going to happen, in my humble opinion -- Apple did recall the iPhone due to its reported antenna/reception issues, it would cost the company US$1.5 billion, according to Bernstein Research analyst Toni Sacconaghi. That's 3.5% of the company's total, on-hand cash. However, even Saccogaghi says such a recall is highly unlikely. "CNET" (http://news.cnet.com/8301-31021_3-20010443-260.html) says that what would be more likely -- and cheaper -- is that Apple could issue a free rubber bumper case with each smartphone. That would prevent a person's hand from coming into contact with the phone's antenna, which is built into its exterior metal strip. Although Apple charges $29 at retail for the rubber cases, Bernstein estimates that giving them away to iPhone 4 customers would cost the company $1 per unit.

iPhone 4 now odds-on to be recalled
I don't think it will happen, but betting company Paddy Power (http://www.paddypowerplc.com) has slashed the odds on Apple recalling its iPhone 4 from 2/1 to 4/6 making it odds-on that the smartphone be recalled. 

 Complaints about poor reception and a bad report by "Consumer Reports" have sparked a betting frenzy over the past 24 hours with hundreds of punters backing a potential recall with Paddy Power before the bookie had a chance to react.

Skype has announced a new version of the SkypeKit Beta SDK (software development kit) that works on Mac OS X and Windows. Now almost any desktop application can offer Skype conversations -- including video, voice, and text -- without the need for users to separately download Skype software. Interested desktop developers can visit http://developer.skype.com/signup to request an invitation to the beta. Just remember: beta software is unfinished software so use with care.

IMCapture has released IMCapture for Yahoo Messenger (http://www.imcapture.com/IMCapture_for_Yahoo_Messenger/), which expands the standard notion of on-line communication allowing the user to record audio and video calls from Yahoo Messenger in a "double click" way. Provided with the record feature, IMCapture for Yahoo Messenger features settings to adjust the quality of the video as well. After setting "record audio" and "record video" by default, it captures all calls automatically. This software saves and converts audio and video calls as MP3, WMA or AAC files and QuickTime Movies (MOV), MPEG4, MPEG, VOB, PSP MPEG4, SWF and FLV correspondingly. The upgrade allows users to insert the name of the enclosing folder into file names in a variety of new ways. A Better Finder Rename costs US$19.95. FoneSync for LG update supports Samsung phone syncing
Nova media (http://www.novamedia.de) has updated FoneSync for LG, a solution to synchronize LG phones with Mac OS X, to version 1.0.3. The new version allows users to synchronize contacts and calendars with Samsung phones, which could not be synced with the Mac OS X before. FoneSync can be set to synchronize single address book groups and single calendars. The synchronization of contacts can be restricted to those that include at least one phone number and the time frame in which calendar events are synchronized can be altered as well. FoneSync for Samsung phones is available for US$19.95. It requires Mac OS X 10.5.8 or higher and a Bluetooth-enabled Mac.

Password Repository for Mac OS X beefs up user interface
Tension Software has updated Password Repository (http://www.pomola.com/products_passwordrepository/passwordrepository.html), a Mac OS X password storage utility, to version 2.12. The upgrade sports a tweaked user interface, the ability to move the search field via keyboard shortcut and menu, and better handling of record creation. Password Repository lets you save all your passwords in documents protecting them on disk using a single password. Data is encrypted using strong and bullet proof algorithms, and the password protecting a document is not saved in any place. Password Repository costs US$30, though version 2.12 is a free update for registered users of version 2.0. The software is Universal Binary so runs natively on both PowerPC and Intel Macs. It requires Mac OS X 10.5 or higher.

Chronicle update lets you pay bills from Overview screen
LittleFin Software has released Chronicle 3.3.1 (http://www.littlefin.com/chronicle.html), an update to their home finance and bill paying application for Mac OS X. Now bills can be paid directly from the Overview screen. Chronicle provides a graphical means to enter and track finances. Features include: automatic bill paying reminder; long-term debt tracking; database of payments and receipts; graphs and reports which analyze trends and averages; and a sortable list of upcoming bills which can be paid on-line from within the app. In addition, Chronicle analyzes payments by month and year and displays the information graphically. Pixelmator for Mac OS X gets faster, adds new features

Canada Type font collection available from Ascender
Ascender Corp. says that the Canada Type font design studio has come to a font distribution agreement with Ascender.   Rebecca Alaccari and Patrick Griffin founded the Toronto-based Canada Type back in early 2004. Since its establishment, Canada Type has created a variety of typefaces for design professionals and creative enthusiasts. The Canada Type fonts have appeared on everything from large corporate projects to small personal design work.   The Canada Type font collection will add a number of enhanced versions of historical typefaces and expertly-designed original fonts to Ascender’s diverse collection of fonts. This includes a line-up of script fonts and a variety of exclusive psychedelic fonts from the ‘60s and ‘70s. Avenza announces Terrain Shader functionality for Photoshop
Avenza Systems (http://www.avenza.com), producers of MAPublisher cartographic software for Adobe Illustrator and Geographic Imager spatial tools for Adobe Photoshop, has announced that the upcoming release of Geographic Imager, version 3.2, will include the ability to dynamically apply terrain shading and colorization to digital elevation models within Adobe Photoshop. The Geographic Imager Terrain Shader functionality will be included as a standard feature in the upcoming release. For the first time, users will be able to easily and quickly import a DEM, apply colors and shades based on elevation and even apply a specific light source position and intensity to achieve a specific shading effect, all within Adobe Photoshop, according to Avenza President Ted Florence. PCI Geomatics releases upgrade to feature extraction software

DasBoot now Snow Leopard compatible
