Study: Apple, Intel, Cisco offer best product, relationship...
A new research report published by the Temkin Group (http://www.temkingroup.com), "Tech Vendors: Benchmarking Product and Relationship Satisfaction of IT Clients," rates the experiences delivered by 60 large technology providers. Looking across the two key areas, products and relationships, Intel, Apple, and Cisco earned the highest average ratings. While the average rating across all 60 tech vendors was 50%, eight vendors fell below 40%: Compuware, Wipro, Capgemini, Tata Consulting Services, Unisys, Novell, Qualcomm, and SunGard. "The research uncovered a wide range of experience delivered by tech vendors when it comes to both products and relationships," states Bruce Temkin, author of the report and managing partner of the Temkin Group. Kodak against restart of Apple litigation
Eastman Kodak has asked a bankruptcy court to decide on its patent dispute with Apple, opposing a motion by Apple for permission to resume the patent litigation in another court, reports "PC World" (http://macte.ch/ipsXl). Kodak, which filed for bankruptcy in January, said in a filing that the bankruptcy court for the Southern District of New York and not a separate court should decide on the ownership of the disputed U.S. Patent No. 6,292,218. The chapter 11 cases would quickly become unmanageable, if ownership claims relating to the estate were litigated on a piecemeal basis in courts around the country, the company claims. Eastman Kodak has agreed to sell its online photo services business to Shutterfly Inc for US$23.8 million; however a dispute with Apple over patent rights is complicating things, reports "Reuters" (http://macte.ch/vKdNf). The company that invented the hand-held camera has said it will quit the camera business and is expected to fetch $1 billion to $2 billion...

Motorola must show Apple details of Google's acquisition...
The U.S. Circuit Judge overseeing the patent dispute between Apple and Motorola Mobility has ordered the latter to provide the former with details of Google's $12.5 billion acquisition as well as information about the development of Android, reports "AppleInsider" (http://www.appleinsider.com). In a filing on March 2, Apple requested to obtain the information stating that "the Android/Motorola acquisition discovery is highly relevant to Apple’s claims and defenses" in its ongoing patent suit against Motorola. Last week Apple won a German appeals court ruling temporarily blocking the enforcement of a patent verdict obtained by Motorola Mobility in December, reports "Bloomberg" (http://macte.ch/HS2Uf). Motorola Mobility, which forced Apple to remove some iPad and iPhone models from its German online store for a short period, can’t enforce the verdict during an appeal, the article adds. The ruling was issued after Apple revised license-agreement terms it offered Motorola Mobility, the...

Russia: the iPad is a computer
Russia's national customs agency has reclassified the iPad as a personal computer, a change that will allow customers to avoid a 5% import tax that was previously applied to sales, according to the Russian-language Vedomosi" publication -- as reported by "AppleInsider" (http://www.appleinsider.com). Russia's Federal Customs Service has nixed the 5% fee by nixing the "navigator" classification that was previously applied to the iPad, the article adds. The Apple tablet was previously considered a navigation device because it can include a GPS radio for positioning data. However, as "AppleInsider" notes, only the 3G-equipped iPad model includes GPS; the Wi-Fi-only model doesn't.

The lawsuit is seeking unspecified damages from Apple and future royalty payments for every device made that utilizes the infringed patent. Interestingly, as noted by "ubergizmo" (http://macte.ch/iI0kx), Core Wireless is in charge of managing a portfolio of 2,000 patents, "most of them are reportedly owned by Nokia, and Microsoft supposedly has a financial interest in the group as a portion of past, current and future legal settlements are expected to make its way into Microsoft’s bank account, as well."

iOS runs HTML5 games much faster than the Android OS
A new study by Spaceport (http://spaceport.io/), the cross-platform mobile game development tool maker, says that Apple's iOS runs HTML5 games three times faster than the Android operating system, reports "VentureBeat" (http://macte.ch/igwYf). Spaceport.io created a benchmark dubbed PerfMarks to test performance at running HTML5 code. The benchmark tested a device’s ability to animate image movement. Repeated tests showe that iOS performed far better at running animations than Android, notes "VentureBeat."The newest iPhone 4S scored 252 PerfMarks and the iPad 2 score 327. That compares to just 53 for the iPhone 3GS from 2009. By comparison, the Samsung Galaxy Nexus smartphone scored 147 and the Kindle Fire scored only 25. Miller and Johnson worked at Apple at the same time, from 2003 to 2004, but in separate departments. "Forbes" notes that Miller joins a growing number of Apple alumni at J.C. Penney. Johnson has already named Michael Kramer (formerly chief financial officer of Apple Retai) as chief operating officer, Daniel Walker (former chief talent officer at Apple) as chief talent officer and Kristen Blum (former director of Supply Chain Solutions at Apple) as chief technology officer.

"When someone takes a private photo, on a private cell phone, it should remain just that: private." Such usage violates both Apple’s and Google’s terms of service, Schumer argues. Apple hasn't commented.

AT&T Relents SOME on "Unlimited" Data Plan Limits
According to Associate Press (http://finance.yahoo.com/news/t-relents-unlimited-data-plan-174637221.html), AT&T is relenting some on its unpopular policies towards "unlimited" users. Recently, there's been reports of AT&T throttling unlimited users starting at as little as 1.5 gigabytes of usage -- as as AT&T ahas said, when users entered the "heaviest 5 percent" of data users for that month or that area. Thursday, the company has changed its policy and will now slow down "unlimited" data users after they reach 3 gigabytes within a billing cycle. Until the change, there was no way for users to find out at what point they would be throttled. Instead, AT&T would send a text message to the customer when they were approaching being throttled. With the new policy, they know the limits of their "unlimited" data plan. According to AP, "AT&T has about 17 million 'unlimited' smartphone subscribers, most of whom use iPhones." Furthermore, "As part of the new policy, the...

Kodak/Shutterfly deal faces hurdles due to legal battle with...
The bankrupt Eastman Kodak has agreed to sell its online photo services business to Shutterfly Inc for US$23.8 million; however a dispute with Apple over patent rights is complicating things, reports "Reuters" (http://macte.ch/vKdNf). The company that invented the hand-held camera has said it will quit the camera business and is expected to fetch $1 billion to $2 billion from the sale of about 1,100 digital patents, which is due to get under way by June 30, the article adds. At a hearing next week on March 8, a bankruptcy judge will hear Apple's motion to move forward with its patent-infringement suit. Apple has asked the bankruptcy court to lift the automatic stay applied to pending litigation against Kodak when the company filed for Chapter 11 on Jan. 19. According to a January filing submitted to the US Bankruptcy Court in the Southern District of New York, Apple stateds that Kodak is seeking authority to "enter into a $950 million postpetition financing facility secured by...

A German court on Friday dismissed two cases brought by Apple and Samsung against each other as part of an ongoing legal battle, reports "Reuters" (http://macte.ch/9HiXf). The decision by a regional court in Mannheim covered a claim by Apple that Samsung infringed on its slide-to-lock technology as well as one of three patents Samsung claimed Apple violated. This is another round in the global, ongoing brouhaha between Apple and Samsung involving patent disputes. The two companies have filed more than 30 lawsuits against each other across four continents. The German court is expected to make a decision on March 16 on another slide-to-unlock suit Apple has brought against Samsung.

Consumer watchdog: Google's new 'privacy policy'...
As Google has killed 60 separate "privacy" policies for its services and said it would now combine data between services despite widespread objection, Consumer Watchdog (http://www.ConsumerWatchdog.org) said the new unified policy isn't a privacy policy; it's a "spy policy." "Calling this a 'privacy policy' is Orwellian doublespeak," says John Simpson, Consumer Watchdog's Privacy project director. "Google isn't telling you about protecting your privacy.  Google is telling you how they will gather information about you on all its services, combine it in new ways and use the fat new digital dossiers to sell more ads.  They're telling you how they plan to spy on you.  It's a spy policy." Google announced the plans in January. Shortly after the announcement, Stanford Researcher Jonathan Mayer found that Google was circumventing privacy settings on the Safari web browser, which is used on the iPad and iPhone. Google also gave false advice on its website about the effect of the settings it...

Wireless data problems increase with rise of web apps
Overall wireless network problem incidence has increased from 2011, driven primarily by issues with data services including mobile Web and email, according to the J.D. Power and Associates (http://www.jdpower.com/) "2012 U.S. Wireless Network Quality Performance Study." Now in its 10th year, this semiannual study evaluates wireless customers' most recent usage activities in three areas that impact network performance: calling, messaging and data. Overall network performance is based on 10 problem areas that affect the customer experience: dropped calls; calls not connected; audio issues; failed/late voicemails; lost calls; text transmission failures; late text message notifications; Web connection errors; email connection errors; and slow downloads. Network performance issues are measured as problems per 100 (PP100) network connections, where a lower score reflects fewer problems and better network performance. Carrier performance is examined in six regions: Northeast; Mid-Atlantic;...

Apple wins injunction against Motorola Mobility (updated)
Germany: Presiding Judge Dr. Peter Guntz of the Munich I Regional Court announced that Apple has won an injunction against all Motorola Mobility devices that violate Apple's patent for a "portable electronic device for photo management," reports "FOSS Patents" (http://macte.ch/ADMcr). "If Apple enforces the ruling, it can even require Motorola to destroy any infringing products in its possession in Germany and recall, at MMI's expense, any infringing products from German retailers in order to have them destroyed as well," writes Florian Mueller for "FOSS Patents." This is part of an ongoing battle between the two companies. Apple has previously alleged that Motorola infringes 24 of its patents (21 of them with Android-based phones, the remaining three with set-top boxes and DVRs), while Motorola previously asserted 18 patents against a variety of Apple products (mostly but not exclusively iPhone, iPad and iPod). Litigation between the two companies has taken place in several...

Apple bargaining with content provides for streaming TV service
Apple is going ahead with plans to launch a streaming TV service by Christmas "despite making little headway in its negotiations with content providers," according to "The New York Post" (http://macte.ch/Rqaes). Eddie Cue, Apple's senior vice president for Internet software and services, has been leading talks with content providers, the article says. However, the content providers have, so far, balked at Apple's desire to exert control over all aspects of the video service, including pricing, claims "The Post." Apple is purportedly pitching the idea of offering channels as apps for its devices, including its Apple TV set-top box. It’s unclear whether it would group the apps together and charge a fee — similar to a cable-TV subscription — or offer the channels on an a la carte basis, says "The Post."

Apple number one on 'Most Admired Companies' list
Apple ranks number one on the "World's Most Admired Companies 2012" list as compiled by "Fortune" magazine. It's the fifth consecutive time Apple has topped the list. Here's what Fortune has to say about our favorite tech company: "To say it was another big year for Apple would be a gross understatement. With the passing of Steve Jobs, questions swirled around the company’s future. But under new CEO Tim Cook’s guidance, Apple continues to prosper. The company’s annual revenues climbed to $108 billion, led by an 81% increase in iPhone sales -- a jump that doesn’t factor in the runaway success of the iPhone 4S -- and a 334% spike in iPad sales, due in no small part to the revamped iPad 2. Increased sales across the board explain why shares soared 75% during the company’s fiscal year to $495."
