Germany: Presiding Judge Dr. Peter Guntz of the Munich I Regional Court announced that Apple has won an injunction against all Motorola Mobility devices that violate Apple's patent for a "portable electronic device for photo management," reports "FOSS Patents" (http://macte.ch/ADMcr).

"If Apple enforces the ruling, it can even require Motorola to destroy any infringing products in its possession in Germany and recall, at MMI's expense, any infringing products from German retailers in order to have them destroyed as well," writes Florian Mueller for "FOSS Patents."

This is part of an ongoing battle between the two companies. Apple has previously alleged that Motorola infringes 24 of its patents (21 of them with Android-based phones, the remaining three with set-top boxes and DVRs), while Motorola previously asserted 18 patents against a variety of Apple products (mostly but not exclusively iPhone, iPad and iPod). Litigation between the two companies has taken place in several different federal courts.

In November 2010 Apple sued Motorola, alleging that the company's smartphone lineup and the operating software it uses infringe on the iPhone-maker's intellectual property. The two lawsuits came after Motorola sued Apple in October 2010 for patent infringement. Motorola claims that Apple's iPhone, iPad, iPod touch and certain Mac computers infringe Motorola patents.

In a statement to MacTech/MacNews, a Motorola Mobility spokesperson had this to say: "Today’s ruling in Munich, Germany on the patent litigation brought by Apple concerns a software feature associated with performing certain functions when viewing photos in a ‘zoomed in’ mode on mobile devices. We note that the Court ruled that performing the functions in a ‘zoomed out’ mode does not infringe on this patent. We expect no impact to supply or future sales as we have already implemented a new way to view photos on our products that does not interfere with the user experience.”
