The Brazilian Institute for Industrial Property (INPI) has nixed Apple's request to retain exclusive legal rights to the word "iPhone," reports "Forbes" (www.forbes.com/fdc/welcome_mjx.shtml).
Gradiente, a Brazilian electronics company, had first requested to trademark "iPhone" as their brand back in 2000 before Apple’s smartphone was unveiled. INPI gave Gradiente that exclusivity in 2008 for their G-Gradiente iPhone, which runs the Android operating system.

Apple updates OS X Server app to version 2.21
Apple has updated its OS X Server app for Mountain Lion to version 2.21. It improves the speed of downloading Mac App Store software, adds Time Machine service monitoring, brings Retina display support for the Wiki Server, adds the ability to use Active Directory groups in Profile Manager and more.
OS X Server lets Mountain Lion users turn the OS into a server OS utilizing a suite of utilities included in the application. The US$20 app is available at the Mac App Store. The 2.21 update is available via the Software Update component of the Mac OS X Systems Preferences app.
Sauce Labs launches service for testing iOS apps in the Cloud
Sauce Labs (https://saucelabs.com), a leading provider of cloud-based web application testing solutions for software developers, has announced a new service, based on the open source project Appium, for automating the testing of applications for iOS devices.
The new service provides a cloud-based, automated testing platform for both native iOS apps and mobile web hybrid apps. In building its Appium on Sauce, the company has contributed to the open source Appium project, based on the Node.js platform. Appium currently features support for native and mobile web automation on iOS, and Android support is planned.

Court: Apple, others didn't break California law
Apple and other online retailers didn't break California law by requiring consumers to provide their address and phone numbers as a condition of accepting credit card payments, the state's high court has ruled, reports "Reuters" (http://tinyurl.com/ajge3xd)
The California Supreme Court, in a split decision, said state privacy protections for credit cards don't apply to online purchases that are downloaded electronically. The ruling comes after the same court in 2011 said that those privacy protections do apply to brick and mortar retailers, finding that they could not request a customer's ZIP code during a credit card transaction, notes "Reuters."

A lower court judge had rejected Apple's bid for a permanent injunction following a jury trial last year. Apple allows Java back on the Mac
Apple has issued an update to Java, returning it to the Mac, reports "Macworld UK" (http://tinyurl.com/au2maq7). Apple had barred Java from running on Macs due to security issues.
On Jan. 31, Apple blocked Java 7 Update 11 by adding it to the banned list in XProtect. Java quickly released an update -- which Apple promptly banned, again for security reasons. On Feb. 1 Oracle released yet another updated version of Java 7, which Apple seems to have okayed.

Foxconn to allow union elections for the first time
Foxconn, the manufacturer of iPhone and iPad, among other products, will allow workers to elect union representatives for the first time, reports "The Telegraph" (http://tinyurl.com/aqop3qp).
The firm said it would hold elections for a chairman and 20 members of its Federation of Labour Unions Committee every five years. Taiwan-based Foxconn employs around 1.2 million workers across China. The move comes in response to pressure on Foxconn from Apple and its own workers over pay and conditions, notes "The Telegraph."

The Semiconductor Industry Association (SIA), representing U.S. leadership in semiconductor manufacturing and design, announced that worldwide semiconductor sales for 2012 reached US$291.6 billion, the industry’s third-highest yearly total ever -- but a decrease of 2.7% from the record total of $299.5 billion set in 2011.
Total sales for the year narrowly beat expectations from the World Semiconductor Trade Statistics (WSTS) organization’s industry forecast. Global sales for the month of December 2012 hit $24.7 billion, a decline of 3% from the previous month when sales were $25.5 billion. Fourth quarter sales of $74.2 billion were 3.8% higher than the total of $71.5 billion from the fourth quarter of 2011. All monthly sales numbers represent a three-month moving average.

Apple execs, Turkish prez meet to discuss education initiative
According to "MacRumors" (www.macrumors.com) Apple executives including vice president for education John Couch have met with Turkish president Abdullah Gül today to discuss several issues, including an iPad education initiative.

iPhone now has 12% of mainland China smartphone market
Mainland China smartphone shipments grew 64% annually to reach 53 million units in the fourth quarter of 2012, according to the Strategy Analytics research group (www.strategyanalytics.com).
Android phones accounted for a record 86% share of all smartphones shipped in China this quarter. Apple iOS followed with 12% share. That's up from 7.5% a year ago.
Apple in talks to bring HBO Go to the Apple TV?

Apple to quit selling Mac Pros in Europe
Apple has issued a notice to European distributors indicating that it will halt sales of the Mac Pro in Europe and select other countries as of March 1 due to new regulatory requirements going into effect on that date, notes "MacRumors" (www.macrumors.com).
The move will affect all European Union countries, as well as EU candidate countries and the four European Free Trade Association countries: Iceland, Liechtenstein, Norway, and Switzerland.
Here's what Apple's note says: "As of March 1, 2013, Apple will no longer sell Mac Pro in EU, EU candidate and EFTA countries because these systems are not compliant with Amendment 1 of regulation IEC 60950-1, Second Edition which becomes effective on this date. Apple resellers can continue to sell any remaining inventory of Mac Pro after March 1.

Apple has rolled out three SMC updates. Each addresses an unexpected shutdown issue on MacBooks containing batteries with over one thousand charge cycles. The updates are available now for the non-Retina MacBook Pro, MacBook Air, and legacy MacBook via the Software Updates component of the Mac OS X Systems Preferences app.

SilhouetteFX LLC releases Silhouette V5
SilhouetteFX has released version 5 of Silhouette, its stereo roto, paint and keying software. The upgrade sports a new raster/vector hybrid paint system, semi-automatic 2D to 3D conversion, a fresh look at shape-based warping and morphing, and the inclusion of planar tracking technology from Imagineer System's mocha Pro.
An option available at an additional cost of $3,995 (for a limited time; it's regularly $5,995), a S3D node for Silhouette 5 facilitates 2D to 3D conversion and stereoscopic processing in six ways. Silhouette’s roto tools have become depth-enabled (in the S3D option). Every shape has a depth that can be keyframed.

Ergonis Software has published extended shortcut descriptions for Avid Technology's Pro Tools. The descriptions can be imported in KeyCue 6 to reveal 189 hidden keyboard shortcuts in Pro Tools.
KeyCue is a tool for learning and remembering keyboard shortcuts. Whenever the command key is kept pressed for a while, KeyCue displays a table with all keyboard shortcuts available in the currently active application. Similar add-ons are available for InDesign, Illustrator, Photoshop and more.
The shortcut descriptions mentioned in this release are not functional as stand-alone tools, but require a licensed version of KeyCue 6.0 or newer. Monotype launches Typecast web design app
Monotype Imaging Holdings (www.monotype.com) -- a provider of typefaces, technology and expertise for creative applications and consumer devices -- has announced the commercial launch of its Typecast application, a browser-based tool for designing Web pages with Web fonts. It launches commercially after a year and a half in private and public beta programs.
Web designers are able to combine, compare and style Web fonts without performing screen captures in third-party applications or through hand coding. Users can visually style text directly within the browser. As designers work, Typecast software generates production-ready HTML and CSS code behind the scenes. When designers are ready to start building their sites, they can export that HTML and CSS, plus generate embedded code that will serve their project’s typefaces to their site.

Judge says Samsung didn't willfully violate Apple patents
Judge Lucy Koh, the federal judge presiding over two Apple v. Samsung lawsuits in the Northern District of California, has entered four more post-trial orders. The biggest news is that, unlike the fury, she found that Samsung's infringement of Apple's patents wasn't willful.
As reported by "FOSS Patents" (http://www.fosspatents.com) the judge:
° Reversed the finding that Samsung's acts of patent infringement were willful (because Samsung had reasons to believe that what it was doing was legal) and overruled the jury with respect to a patent exhaustion question (which has no effect because the related patent was not deemed infringed by Apple), but otherwise upheld the jury's liability findings against Samsung, denying further modifications as well as a new trial;
° Denied Apple any damages enhancements for willful infringement (which could have resulted in a tripling of parts of the award); she also denied enhancements of trade dress damages on other grounds;

Judge says Apple patents not invalid due to 'indefiniteness...
U.S. District Court Judge Lucy Koh has ruled that neither an Apple utility patent nor four design patents are invalid due to indefiniteness, reports "AppleInsider" (www.appleinsider.com).
The issue of indefiniteness was first entered during the Apple v. Samsung trial over Apple's U.S. Patent No. 7,864,163, otherwise known as the "tap to zoom" patent, when Samsung took issue with the term “substantially centered.”
In the patent language, Apple refers to graphical assets being "substantially centered" on a portable device's display. Samsung argued that the term was indefinite and thus the patent should be invalidated, notes "AppleInsider." Koh disagreed and denied the invalidation by citing a number of federal court cases that set precedent pertaining to the term "substantially."
