Lawsuit alleging that Apple violates privacy is dismissed
A class action suit alleging that Apple, app developers, and mobile advertising companies violated the privacy rights of iPhone users has been dismissed for lack of standing, reports the "Eric Goldman Technology & Marketing Law Blog" (http://macte.ch/UxTa6). The lawsuit charged Apple with sharing information about users' browsing history, application use and other personal details without their consent. The suit said:"Apple's privacy policy is opaque and confusing but one thing is clear: it does not inform mobile device users that by providing application developers with their UDID, Apple enables them to put a name to highly personal and in many cases embarrassing information derived from app downloading activity and usage, and internet browsing history, that would otherwise be anonymous." Apple argued that various end user agreements barred claims for the alleged injuries. Per "Eric Goldman," in the dismissal notice filed on Sept. 20, the U.S. District Court for the Northern...

Nielsen: Apple iOS has 28% of US smartphone market
According to an August survey by the Nielsen research group (http://www.nielsen.com), 43% of all smartphone owners have an Android device and 28% have an Apple iOS device. However, if you ask only those who got a new smartphone in the past three months what kind of phone they chose, more than half (56%) will tell you they picked an Android device, according to Nielsen.. The preferences of these so-called “recent acquirers” are important as they are often a leading indicator of where the market is going, says the research group. Apple iOS remains popular in second place with 28 percent of all smartphone users, and the same percentage among those who recently got a new device. But those figures could change quickly in the months to come, says Nielsen. Every time Apple launches a new iPhone or makes it available on a new wireless carrier, there is an increase in their sales. Changes in share aside, the smartphone pie is getting bigger. While 43% of all mobile subscribers in the US had a...

Intego warns of Mac Flashback Trojan Horse
Intego (http://www.integro.com) says it has discovered a new Trojan horse, Flashback, which masquerades as a Flash Player installer. This Trojan horse has been found in the wild, and has some disturbing actions, according to Intego. Users visiting certain malicious websites may see a link or an icon to download and install Flash Player. Since Mac OS X 10.7 ("Lion") doesn't include Flash Player, some users may be fooled, says Intego. "If the user proceeds with the installation procedure, the installer for this Trojan horse will deactivate some network security software, and, after installation, will delete the installation package itself," the security company adds. "The malware installs a dyld (dynamic loader) library and auto-launch code, allowing it to inject code into applications the user launches. This code, installed in a file at ~/Library/Preferences/Preferences.dylib, connects to a remote server, and sends information about the infected Mac to this server: this includes the...

iPad orders cut -- or maybe not
JP Morgan’s Gokul Hariharan, who covers contract manufacturer Hon Hai Precision, told clients in a note -- as reported by "Barron's" (http://macte.ch/zy7cb) -- that Apple appears to be cutting production of the iPad for the fourth quarter, citing multiple sources from the electronics supply chain. However, Susquehanna’s semiconductor analyst Chris Caso disagrees. "Multiple supply chain vendors indicate a 25% cut for 4Q11 iPad sell-in orders (first cut ever that we have seen) in the past two weeks, which would mean that Hon Hai ‘s iPad shipments may be down 25% qoq [quarter-over-quarter] in 4Q11 (from sell-in of 17 million in 3Q11 to 13 million in 4Q11)," writes Hariharan. However, Case counters: "We ￿believe ￿chatter￿ regarding ￿iPad￿production ￿cuts ￿are ￿misleading￿-￿we￿ have ￿seen ￿pull-ins, ￿not￿ cuts. We have noted recent comments by competitors discussing iPad production cuts for 4Q. Our recently published AAPL supply-chain checks noted a sequential decline in 4Q iPad builds...

Samsung says, Apple says -- and so it goes
The legal brouhaha between Apple and Samsung continues (not that you're surprised, are you?). Apple has infringed upon Samsung Electronics patents since entering the mobile phone market with the iPhone 3G, a lawyer for Samsung told a Dutch court as the company seeks a ban on some Apple products in the Netherlands, reports "Bloomberg" (http://macte.ch/7bk31). “Apple just entered the market in 2008 without taking care of the licenses,” Bas Berghuis van Woortman, a lawyer for Simmons & Simmons LLP who represents Samsung, said in The Hague court. “Apple is consciously, structurally infringing the 3G patents.” Samsung filed four lawsuits against Apple in the Netherlands and the first scheduled hearing is today. Samsung is claiming the iPhone and iPad that use 3G technology infringe Samsung patents and is seeking a ban on their sale in the Netherlands. Meanwhile, Apple said in a Hague court hearing that Samsung is holding them "hostage" by asking for 2.4% on each 3G chip used in the...

Apple meets with Chinese environmental groups
Apple held talks with Chinese environmental groups earlier this month after the U.S. tech giant was criticized for using manufacturers accused of polluting the environment in China, according to the IDC News Service. The Institute of Public and Environmental Affairs (IPE), a group based in Beijing, said it held the talks with Apple following a request made by the company, the article adds. IPE called the initiation of talks a positive sign as this was the first time Apple had responded to the environmental groups' concerns about the company's suppliers. In the past, IPE and other groups have released reports accusing Apple of failing to monitor the work conditions and manufacturing processes used by its various suppliers in China. IPE said it held talks twice with Apple, the second time with the company's supply chain management. While Apple did not specifically address all of the concerns the environmental groups made, the company said it would continue to communicate and...

Verizon sides with Samsung in Apple case
"FOSS Patents" (http://macte.ch/BWN4L) says Verizon, the largest U.S. wireless carrier, has implored the United States District Court for the Northern District of California to deny Apple's request for a US-wide preliminary injunction against four Samsung products (the Infuse 4G, Galaxy S 4G and Droid Charge smartphones, and the Galaxy Tab 10.1 tablet computer), arguing that such a decision would run counter to the public interest as it "would hinder Verizon Wireless in developing and deploying its next generation high-speed LTE [fourth-generation] network, the job growth dependant on that network, and will undercut key public policy goals, including expansion of American's [sic] access to broadband networks and faster communication with emergency personnel." Verizon recently proposed that President Barack Obama should exercise his presidential veto right against possible ITC import bans against Apple's as well as Android-based devices. Now the company has filed a motion for leave (a...

S3 Graphics sues Apple -- again
S3 Graphics, a company HTC is in the process of buying has sued Apple (again), this time accusing the company of violating two different patents, reports "FOSS Patents" (http://macte.ch/QYw5u). S3 has asked infringing products -- the iPhone, iPod touch, iPad and Macs -- be barred from sale. A complaint with the U.S. International Trade Commission was accompanied by a federal lawsuit filed in U.S. District Court in the district of Delaware. The beef between Apple and HTC/S3 started in March 2010 with Apple's first ITC complaint against HTC. In May 2010, HTC retaliated with an ITC complaint against Apple, and S3 Graphics filed its first ITC complaint against Apple. In July 2011 the U.S. International Trade Commission ruled that Mac OS X violates patents held by S3 Graphics, while the platform for the iPhone, iPod touch and iPad tablet doesn't. The operating system on the Mac infringes two S3 patents related to graphics chips, Judge James Gildea said. S3 Graphics makes image compression...

Mac PDF Trojan Horse gallops onto the scene
Security specialist Intego (http://www.intego.com) says a new malware sample affecting Mac OS X has been discovered. It's an application masquerading as a PDF file, which connects to a remote server to download a backdoor. This application displays text, like a PDF, to fool users who open it, and don’t notice what really happens, says Intego. When a user opens the file, the executable goes into action, extracting a different executable, which then downloads a backdoor from a remote server. This first executable only works on Intel-based Macs, and the backdoor doesn't work on Macs using a case-sensitive file system (which is not the default). The backdoor takes screenshots and sends them to a command and control server, and can perform other actions. "This PDF Trojan horse was not found in the wild, and is most likely simply a proof of concept," says Intego. "Its design is clunky, yet it can work, and does connect to an active server. VirusBarrier X6 users will find that the program’...

LVL Patent Group sues Apple, 26 other companies
Another day, another lawsuit. LVL Patent Group is suing Apple and 26 other companies for patent infringement involving wireless recordings of transactions. The lawsuit accuses the 27 companies -- which include AT&T, Verizon, Sprint, T-Mobile, RIM, Nokia, Samsung Motorola, HTC and HP -- of violating a total of four patents, notes "AppleInsider" (http://www.appleinsider.com). While three of them were granted in 2000 and earlier, one invention entitled "Telephone/Transaction Entry Device and System for Entering Transaction Data Into Databases" was issued earlier this month, on Sept. 13, by the U.S. Patent and Trademark Office, the article adds. LVL Patent Group says Apple and other wireless handset manufacturers are violating the three patents "by making, using, selling, offering to sell, or importing mobile communication devices that include a data transaction assembly server." LVL has said that this alleged infringement has resulted in "monetary damages in an amount not yet...

Analyst: Apple is primary beneficiary of the '...
In a note to clients -- as reported by "Forbes" (http://macte.ch/HGAdn) -- Barclays Capital lifted his price target on Apple from US$515 to $555. "On the back of our recent trip to Asia and checks within retail, our research continues to point to upside for iPhones, iPads, and Macs -- even as the economy softens," he says. "Yes, the economy is a major concern for all companies but macro events don’t seem to be impacting Apple’s ascension as the primary disruptive force in hardware. We continue to believe that Apple is the primary beneficiary of the 'consumerization of IT' trend, while also enjoying defensive characteristics in terms of cash flow, net cash and valuation." Retizes says the supply chain is readying to ship up to 40 million iPads in the current calendar year, with production ramping for screens for an iPad 3 by March 2012. As for the iPhone, he says the supply chain could ship as many as 30 million units in the December quarter.

China store openings behind the pace Apple predicted in 2010
Apple is opening stores in the China region at one-fourth the pace it predicted 19 months ago, "giving rival makers of smartphones and tablet computers time to gain users in the world’s biggest mobile-phone market," says "Bloomberg Businessweek" (http://macte.ch/CaLEO). Apple opened its third store in Shanghai Friday and will open its first one in Hong Kong Saturday bringing the total to six in the region. That compares with the 25 stores slated to open by February 2012 that Ron Johnson, then Apple’s head of retail, said last year. Delays in store openings may give makers of smartphones and tablets equipped with Google’s Android software room to gain market share, Shaun Rein, managing director of China Market Research Group, told "Bloomberg Businessweek."
