Apple, Microsoft settle with NTP Inc.
Apple and Microsoft are among the companies that have reached a settlement of patent-infringement claims by NTP Inc., reports "Bloomberg" (http://macte.ch/VSvg7). Financial terms weren’t disclosed in federal court filings in Richmond, Virginia, seeking dismissal of suits filed by NTP beginning in 2007, the article adds. However, the agreements cover most of the wireless phone industry, including phone service companies like AT&T and Verizon Wireless, handset manufacturers such as LG Electronics and and e-mail service providers like Yahoo! Earlier this month, NTP Inc. (http://www.ntp-inc.com/) -- a company that specializes in network monitoring, security and protocol analysis solutions -- filed lawsuits against Apple, Google, HTC Corp., LG Electronics, Microsoft and Motorola in the United States District Court for the Eastern District of Virginia for infringing NTP's eight patents related to the delivery of electronic mail over wireless communications systems. Apple wins European ban on Galaxy Tab
"The Verge" (http://macte.ch/9G5PQ) reports that a ruling from the Dusseldorf Higher Regional Court in Germany clears the way for Samsung’s redesigned Galaxy Tab 10.1N, but extends a German ban on the smaller Galaxy Tab 7.7 to the entire EU as part of the ongoing, global Apple-Samsung legal struggle. Apple sought an injunction against the Galaxy Tab 10.1N, but was denied by the Dusseldorf Regional Court in February. The court said the redesign was distinct enough from the original Galaxy Tab 10.1 that the original injunction ought not to apply.

Apple seeks $2.5 billion in damages from Samsung
Apple is seeking US$2.5 billion in damages and more than $30 per device sold by Samsung for patent infringement, according to new court documents. This is all part of the ongoing, global legal battle. Apple and Samsung have filed more than 30 lawsuits against each other across four continents. For example, Apple alleges that Samsung copied the slide-to-unlock technology of its iPhone and iPad devices. Florian Mueller, writing for "FOSS Patents" (http://macte.ch/Z3JBJ) explains Apple's latest move: "The largest part of Apple's $2.525 billion claim, an amount of $2 billion, is related to Apple's demand for a disgorgement of Samsung's total profits with products that infringed its design patents. A disgorgement of profits is not available with respect to technical patents. But once Apple collects all of Samsung's profits on an allegedly infringing device, it can't claim a 'reasonable royalty' on those devices ... The $2.525 billion amount could still increase. Apple argues that Samsung...

Report: Apple has over 50% of tablet market
According to new data from Research and Markets (http://www.researchandmarkets.com), Apple has over 50% of the tablet market. Even though Intel has been aggressively promoting its ultrabook products aiming to secure its share in the notebook market in 2012, besides notebook computers, most of the vendors still have to deploy tablet related products in order to face possible changes in market structure, according to the research group. Other points from the latest Research and Markets report: ° Microsoft aims to expand the company's footprint into the consumer market, detachable industrial design is adopted by most of the tablet vendors, while the vendors still attempt to differentiate their products through new technology adoption and application service launch ° Price tags of Android-based tablets are projected to fall and increasing Chinese vendors have forayed into the tablet market, but there is still room for improvements for tablets released by Chinese vendors. Proview sued by its own legal counsel
Proview, the Chinese company that sued Apple over the iPad trademark, is now being sued by its own lawyers. The Grandall Law Firm is suing Proview for its 4 percent commission on Apple's $60 million settlement, about $2.5 million, according to a "Sina Tech" story -- as noted by "CNET." Proview founder Yang Rongshan characterized Grandall's lawsuit as "nonsense," the article adds. He claimed that Proview is not currently under "normal operations" and should not be bound by the terms of its obligation to Grandall. Earlier this month, Apple paid US$60 million to Proview Technology to end a dispute over the iPad trademark in China. The settlement was mediated by the Higher People's Court of Guangdong province. In February Proview accused Apple of "deception" in the way it acquired rights to the iPad name. In Californian court filings, Proview claimed Apple created a UK-registered "special purpose company," IP Application Development Ltd (IPADL). For more info, go to http://news.cnet.com/...

Apple ends in-app purchasing flaw
By shutting down hosting servers, banning IP addresses and adding new protections to its iOS 6 firmware, Apple appears to have succeeded in putting an end to the in-app purchasing flaw by Russian hacker Alexey Borodin, reports "The Next Web" (http://macte.ch/3rWv2). Posting to his In-Appstore blog (http://www.in-appstore.com/2012/07/its-all-over-for-now.html), Borodin says that after examination of Apple’s new in-app purchase protections -- which includes the sharing of private APIs [application programming interfaces] -- there's "no way to bypass updated APIs." He adds that "the game is over." "Currently we have no way to bypass updated APIs," writes Borodin. "It's a good news for everyone, we have updated security in iOS, developers have their air-money. But, service will still remain operational until iOS 6 comes out."

Apple: ebook price-fixing case could damage U.S. publishing...
The "IDG News Service" reports that a proposed settlement of the U.S. Department of Justice’s ebook price-fixing case against three large publishers would damage the U.S. publishing industry and would single out Apple for restrictions on ebook pricing, according to notes from Apple lawyers to the agency. The proposed settlement between the DOJ and three of five publishers the agency charged in April with price fixing is “a threat to ebook competition,” lawyers for Apple wrote in comments to the DOJ. “In a misguided attempt to reshape the market according to its own preferences, the government seeks to impose a business model that will result in dramatic and long-lasting harm," the company's lawyers say. In April the United States Department of Justice filed an antitrust lawsuit against Apple, Hachette SA, HarperCollins, Macmillan, Penguin and Simon & Schuster in New York district court, claiming collusion over ebook pricing. Apple and Macmillan, which have refused to engage in...

Apple, Motorola Mobility appeal judge's ruling
Apple and Motorola Mobility, now a subsidiary of Google, have separately appealed the June decision of a U.S. federal judge to throw out their patent infringement case, according to the "IDG News Service" (http://macte.ch/HyLTX). In June U.S. Circuit Judge Richard A. Posner canceled Apple's patent infringement jury trial against Motorola Mobility after rejecting each side’s damages arguments. "You have to prove injury," he told the companies’ lawyers at the time. Posner’s ruling scraps what would have been the first patent trial between them since Google completed its $12.5 billion acquisition of Motorola Mobility Holdings in May. In separate filings Friday, Apple and Motorola Mobility appealed Posner's rulings, notes the "IDG News Service."

In Australia, Apple filed suit against Samsung in July 2011, alleging that the company’s Galaxy tablet infringed on patents related to touchscreen technology, the article adds. Samsung subsequently filed a cross-claim against Apple, claiming violation of three 3G data transmission patents in Apple’s iPhone 4 and 4S models and second iPad model. This is all part of the ongoing, global legal battle. Apple and Samsung have filed more than 30 lawsuits against each other across four continents. For example, Apple alleges that Samsung copied the slide-to-unlock technology of its iPhone and iPad devices.

Kodak loses patent case against Apple, RIM
Kodak has lost a patent case against Apple and RIM, "dealing a blow to the onetime film giant's efforts to raise billions of dollars by selling off its intellectual property," according to "The Wall Street Journal" (http://macte.ch/6fPFB). Kodak filed a complaint against the iPhone and BlackBerry makers at the U.S. International Trade Commission in early 2010, saying their devices infringed on its patent for previewing images with a digital camera. On Friday, the ITC dismissed the complaint, upholding a finding by one of its judges that the patent was invalid. The commission concluded that neither Apple nor RIM had violated trade laws that could have led to an injunction halting imports of their products, adds the "WSJ." Since the patent at issue was one of Kodak's most valuable, the ruling raises fresh questions about how much money the company, now in Chapter 11, can raise from an auction that is expected to conclude next month, the article adds. Kodak plans to appeal the ruling....

More consumers moving toward no-contract cell phones
With the growth in smartphones and wireless data services, will the prepaid wireless market in the U.S. keep expanding?
