Survey: 30/70 revenue split is unfair
Eighty percent of developers in North America think they should receive more than 70% of the revenue generated by their apps in an app store according to the Spring North American Development Survey, an in-depth survey of over 400 developers conducted last month by Evans Data Corp. (http://www.evansdata.com), which provides regularly updated IT industry market intelligence based on in-depth surveys of the global developer population.
Perhaps consequentially, app stores are the preferred distribution model for only 15% of North American developers, with over half preferring direct sales to end-users or enterprises. Additionally, developers bridle against app store imposed restrictions on price and content. Over 70% thought that app stores should not impose any restrictions on price, and while a third thought content restrictions were acceptable, almost half thought there should be none at all.
"Virtually all of the best known app stores have fallen in line directly with the 30 / 70...
Arguments to be heard in 'iPhone prototype' case
A Silicon Valley judge will hear arguments later this week in a dispute over unsealing records about the criminal investigation into what may have been a prototype iPhone purchased by a blog, reports "CNET" (http://news.cnet.com/8301-13579_3-20004673-37.html?tag=mncol).
San Mateo County Judge Clifford Cretan has scheduled a hearing for 9 a.m. on Friday, May 14, in his courtroom in Redwood City, Calif. Cretan previously approved a police request to search the home office of "Gizmodo" editor Jason Chen, which resulted in a hailstorm of criticism.
Media organizations including "CNET," the "Associated Press" and "Bloomberg" are planning to ask Cretan to unseal an affidavit prepared by a San Mateo County detective asking to search Chen's home. The coalition says that under California law, the affidavit became a public document after 10 days and that its release could reveal whether prosecutors followed proper procedures when searching a newsroom.

Apple: the iPhone still leads the Android in market share
The NPD research group recently reported that the market share for Google’s Android platform was now higher than the iPhone’s. Apple disagrees and tells the "Wall Street Journal" (http://blogs.wsj.com/digits/2010/05/10/android-vs-the-iphone-the-battle-...) the info is "limited" and misleading.
Apple points to other figures out recently from IDC indicating that the iPhone has 16.1% of the smart-phone market on a world-wide basis. Those figures put the iPhone well ahead of Android handset makers HTC and Motorola.
“This is a very limited report on 150,000 U.S. consumers responding to an online survey and does not account for the more than 85 million iPhone and iPod touch customers world-wide,” Apple spokeswoman Natalie Harrison told the "Journal" in speaking of the NPD report. “We had a record quarter with iPhone sales growing by 131%, and with our new iPhone OS 4.0 software coming this summer, we see no signs of the competition catching up anytime soon."

Symantec: beware of Apple gift card phishing scam
Creative online crooks have been ripping off Apple gift card holders for more than a month, according to security software vendor Symantec.
"eSecurity Planet" (http://www.esecurityplanet.com/features/article.php/3881231/Phishing-Sca...) says the phishing scam "requires a little bit of luck for the bad guys and lot of naivety on the part of the card holder." The con artists set up a phishing site using a typosquatted URL -- a URL that's a deliberate misspelling of Apple or some derivation of Apple's online store -- and then lies in wait for those folks who hastily typed in the erroneous address.
Once the page is loaded, the bogus site appears to be a legitimate Apple site, complete with the correct customer support phone number and the same look and feel of Apple's consumer web sites. "With the hook baited, the crooks try to reel in consumers by providing what looks like a safe and simple way for card holders to check the balance on their Apple gift cards," notes "eSecurity Planet." US-CERT warns of Safari vulnerability
The United States Computer Emergency Readiness team (US-CERT) is warning that Safari contains a vulnerability in the handling of window objects, which may allow a remote, unauthenticated attacker to execute arbitrary code on a vulnerable system.
"Apple Safari fails to properly handle references to window objects. Safari can allow a window object to be deleted while references to the object may still exist," US-CERT says "If JavaScript code then attempts to use the deleted window object, this can result in the use of an invalid pointer. This pointer can be controlled by an attacker through the use of JavaScript. Exploit code for this vulnerability is publicly available. We have confirmed Apple Safari 4.0.5 on the Windows platform to be vulnerable. Other versions may also be affected."
By convincing a victim to view an HTML document (web page, HTML email, or email attachment) with Apple Safari, an attacker could run arbitrary code with the privileges of the user running the application...

The Kensington Wireless Presenter Pro with Green Laser Pointer will work on virtually any screen or surface.

Apple & AT&T exclusivity deal 'confirmed' to...
The gang at "Engadget" (http://www.engadget.com/2010/05/10/confirmed-apple-and-atandt-signed-fiv...) say they can now confirm that Apple and AT&T entered into a five-year iPhone exclusive in 2007, based on court documents filed by Apple in California.
"An ongoing California class-action lawsuit filed in 2007 claims that Apple and AT&T illegally exerted a monopoly over iPhone service by telling customers the iPhone's required service contract was two years long when the Apple/AT&T exclusivity deal was actually for five years -- thus requiring buyers to re-up with AT&T for three years (and not, say, T-Mobile) if they wanted to keep using the iPhone," the article says. "Obviously Apple had to respond to these allegations, and in addition to arguing that no one was ever promised an unlocked iPhone after two years, the company's lawyers repeatedly confirm the existence of the five-year agreement while noting it was publicly reported in "USA Today'."

iPad versions of iWork apps could generate $40 million in annual...
The iPad version of the iWork apps (Pages, Numbers, Keynote) are already on track to potentially generate more than US$40 million in annual sales, according to an analysis of Apple App Store sales so far by "Silicon Alley Insider" (http://www.businessinsider.com/apple-sales-revenue-pages-keynote-numbers...).
In face, sales of the app have "probably" already passed $3 million in sales so far, the article says. And "Silicon Alley Insider" predicts that Apple's overall iPad revenue could top $1 billion just this quarter.
"Also, the article says "it shows there is a real appetite for serious apps on the iPad, a device that many have shrugged off as a toy." It also suggests that Microsoft and Google may want to make sure their office suites -- whether Web-based or apps -- work well on the iPad, adds "Silicon Alley Insider."
Study: iPad users fascinated, tripped up by apps
The first crop of iPad apps may draw user approval for being "beautiful," but they also create user frustration as people try to figure out where to touch in order to interact with them, according to usability expert Jakob Nielsen whose user-experience research firm Nielsen Norman Group today released results from a usability study of 34 iPad apps.
Not only are users' hard earned web-interaction skills not transferable to iPad apps, the learning for one app does not necessarily apply to the next one. Early iPad apps are marked by inconsistent interaction design.
"It's the Wild West all over again in interaction design," Nielsen says. "We're seeing the same thing we saw 17 years ago in web design when anything a designer could draw could be a user interface whether it made sense or not. That's happening with the iPad apps. Anything you can show and touch can be a user interface on this device. There are no standards or expectations, and users just don't know what to do, or even what...
Analyst talks with 'MacNews' about the Mac's...
In a new report Phil Leigh of "Inside Digital Media" (http://www.insidedigitalmedia.com), a market research firm specializing in the future of media, said Apple will introduce as-yet-unannounced products to address market opportunities in the digital living room and media and transactional online services. But the Mac will continue to play a big role in the company's future.
In fact, in an interview with "MacNews," Leigh says the Mac itself is going to continue to gain consumer market share -- and then more market share in the business world. It's a trend that's already underway.
"Many families will essentially transfer over to the Mac platform," Leight says. "It will be the best choice for many as it's more digital media centered. Then, gradually, we'll see the Mac gain market share in the office environment as top level execs become Mac users and tell their IT departments to make the platform work in their environment."
The analyst doesn't see companies with hundreds of employes and...

No HyperCard for the iPad
In order to support its revMobile customer base, Mirye Software (http://www.mirye.com) says it submitted an in-depth proposal to Apple that it create an iPhone-only product that uses native Cocoa objects, supports 100% of their application programming interface (API), "works perfectly with multitasking and battery life, but uses a variant of the revTalk language to use these objects and APIs, and then translates those into native code.
"While a significant engineering departure for us from the current revMobile path, this solution would have resulted in perfect-quality iPhone-only applications impossible to distinguish from native applications," says Lynn Fredericks of Mirye Software. "Apple clearly and distinctly turned down the proposal with a very clear message from Steve Jobs himself."
he says RunRev is regrouping from this set back, and revMobile as it is planned will be re-engineered into a prototyping tool.
"Our view at Mirye Software is that the field is clear and open for...

Revenue related to consumer use of cloud-based backup/storage sites will grow from almost US$75 million in 2009 to more than $372 million in 2015, at a CAGR [compound annual growth rate] of 27.89%, according to new info from ABI Research (http://www.abiresearch.com).
According to ABI Research practice director Larry Fisher, “The consumer value proposition for many cloud computing applications is simple; they’re free. Most of the 1000+ US consumers responding to a 2010 ABI Research survey said they were hesitant to pay anything for use of a cloud-based service site.”
Right behind the price/cost issue, the major reason most would consider using a cloud-based application was ubiquity: the concept that they could access their valued content from any Internet-connected computer. ABI Research’s analysis found that just 11.6% of the US consumer market for online backup/storage services was paid for in 2009. Most cloud-based backup and storage sites provide consumer services either entirely...

Australia: Apple says it's not profiteering with the iPad
Apple has blamed the GST, not international price gouging, as the reason Australian consumers are being forced to pay more for the iPad, according to the "Herald Sun" (http://www.heraldsun.com.au/entertainment/apple-denies-profiteering-with...).
Victorians will have to pay $629 for the entry level 16GB version of the device -- about $70 more than for the same model sold in the US. Australians will pay an average 12 % more for the six various iPad configurations than US buyers.
Corporate affairs spokeswoman Fiona Martin told the "Herald Sun" if not for the GST component, the difference between an iPad bought in the US and Australia would be marginal.
"The (Australian) price is actually very comparable to the US price," Martin said. "The difference is just the effect of local taxes such as the GST. If you took the GST off it, the difference would be as little as $6 or $7."
In Japan 3G iPad to be SIM-locked
In Japan models of the 3G iPad will be SIM-locked to Softbank Mobile, which has evidently negotiated an exclusivity deal on the device, reports "All Things D" (http://digitaldaily.allthingsd.com/20100510/ipad-3g-sim-locked-to-softba...). Softbank is the exclusive carrier of the iPhone in Japan.
This is a bit surprising since NTT DoCoMo President Ryuji Yamada said during an earnings call last month that the company would sell iPad-compatible micro-SIM cards in time for the device’s launch in the country. But "evidently, Apple has been pleased enough with Softbank’s support for the iPhone to tweak the multiple carrier distribution plan it had intended for the iPad outside the states" or "the company has always been open to international SIM-lock exclusivity deals," says "All Things D."

Analyst: Apple has as-yet-unannounced products for the digital...
Phil Leigh of "Inside Digital Media" (http://www.insidedigitalmedia.com), a market research firm specializing in the future of media, says Apple will introduce as-yet-unannounced products to address huge latent market opportunities in the digital living room and media and transactional online services.
"Since the turn of the century Apple evolved from a secondary computer company into the most potent force transforming media," Leigh says." It is the premier digital media innovator as evidenced by the iPod, iPhone and most recently the iPad. Basically each introduction defined a new product category or enabled an incipient one to 'cross the chasm' into mass market acceptance. More of the same is expected in the future, not only from products but also from transactional services."
Most any business affected by the future of media will be directly impacted by Apple’s future innovations, he adds. Moreover, its existing product lines alone will carry the company past the $100 billion...

New MacBook Air updates this week?
There might be a new MacBook Air released this week, according to "Macworld Australia" (http://www.macworld.com.au/news/view/macbook-air-update-this-week-4886), quoting "a well-placed source familiar with Apple inventory levels and product refreshes."
The source says the number, MC516LL/A K87 BETTER BTR-USA, most likely points to a Mac product due to the "BETTER" segment of the product code. "Macworld Australia" notes that this could refer to a 27-inch display, which could be a new Cinema Display or, less likely, a new, high-end iMac.
However, "it looks like there are several thousand on their way to Australia this week, which suggests a major new product," "Macworld Australia" notes. The MacBook Air was last updated in June 2009.
NPD: Android OS overtakes iPhone OS in smartphone market
The Android operating system (OS) continued to shake up the U.S. mobile phone market in the first quarter (Q1) of 2010, moving past Apple to take the number-two position among smartphone operating systems, according to The NPD Group (http://www.npd.com), a market research company.
NPD’s wireless market research reveals that based on unit sales to consumers last quarter the Android operating system moved into second position at 28% behind RIM’s OS (36%) and ahead of Apple’s OS (21%).
“As in the past, carrier distribution and promotion have played a crucial role in determining smartphone market share,” says Ross Rubin, executive director of industry analysis for NPD. “In order to compete with the iPhone, Verizon Wireless has expanded its buy-one-get-one offer beyond RIM devices to now include all of their smartphones.”
Strong sales of the Droid, Droid Eris, and Blackberry Curve via these promotions helped keep Verizon Wireless’s smartphone sales on par with AT&T in Q1. According to...
President Obama 'declares war' on iPods, iPads, etc.
President Barack Obama, a BlackBerry user, "declared war on technology," singling out Apple’s super-popular iPods and iPads for criticism at a commencement ceremony in Virginia, the "New York Post" and "Fox News" (http://www.foxnews.com/scitech/2010/05/10/obama-warns-grads-twitter-ipad...) report.
"With iPods and iPads and Xboxes and PlayStations -- none of which I know how to work -- information becomes a distraction, a diversion, a form of entertainment, rather than a tool of empowerment, rather than the means of emancipation," Obama said at Hampton University in southeastern Virginia.
Obama described the most popular offerings of companies like Apple, Sony, Microsoft and Nintendo as "distractions" that are putting unnecessary pressure on the country. He also lamented the spread of social media and blogs, through which "some of the craziest claims can quickly claim traction."
