Is the iPhone still Verizon's top-selling smartphone?
In a note to clients -- as noted by "Fortune" William Blair's Anil Doradla notes that although Apple's iPhone is still America's bestselling high-end smartphone, its sales momentum is "under pressure," particularly at Verizon.
According to Doradla's channel checks for the June quarter, the iPhone is no longer the top selling smartphone at Verizon's retail outlets. The analyst attributes the iPhone's fall from grace less to the usual slowdown in advance of a new model than to Verizon's aggressive marketing of competing 4G devices, particularly Motorola's Droid RAZR MAXX, notes "Fortune."
On the other hand, "AppleInsider" notes that Canaccord Geunity analyst Michael Walkley says the iPhone IS still the top-selling smartphone for Verizon. aid while the latest Razr is "gaining ground," it "hasn't caught iPhone." His own research has found the iPhone 4S as the top selling smartphone at Verizon, as well as AT&T and Sprint, for all of 2012 so far.

Apple to ask federal judge to ban Samsung tablet
On Friday, Apple will ask a federal judge in San Jose, California, to pull a model of Samsung tablet computer off the market for allegedly copying its iPad design, reports "Fortune."
In May, a panel of the U.S. Circuit Court of Appeals for the Federal Circuit preliminarily ruled that Apple's iPad design patent, known as D504,889, was valid, the article adds. Circuit Judge William C. Bryson, writing for the panel, then ruled that the iPad design was likely infringed by Samsung's Galaxy 10.1 Tab, which came out in June 2011. He ordered the case sent back to U.S. District Judge Lucy Koh to decide whether to pull the Samsung tablet from shelves immediately or wait till after she has presided over a full jury trial, currently scheduled to start July 30. That preliminary injunction hearing is now set for Friday.
"Fortune" notes that, in the same ruling Judge Bryson also preliminarily approved the validity of two of Apple's iPhone design patents and found that they, too, were likely...

The San Diego Unified School District has purchased nearly 26,000 iPads for use in 340 classrooms that it will provide to students in classrooms this fall, reports "10 News" (http://macte.ch/l4dQL). The US$15 million deal is one of Apple's biggest iPad deals yet.
School officials plan to roll out iPads to 5th-grade, 8th-grade and some high school classes this fall, the article adds. However, some have questioned SD Unified's purchase. One 10News Facebook fan wrote: "I'm so confused. I thought we couldn't afford to even pay the teachers, how can they afford 26,000 iPads???"
Apple-Motorola battle on again
Apple’s battle with Motorola Mobility is on again as the U.S. International Trade Commission (ITC) said it will review an April ruling that Apple infringed one of four patents asserted against it by Motorola Mobility, reports "AllThingsD" (http://macte.ch/gF0Ck).
The commission, which can implement import bans like the one Motorola originally requested on both the iPhone and iPad, is scheduled to issue a final decision in late August, the article adds. All this is part of an ongoing battle between the two companies.
Apple has previously alleged that Motorola infringes 24 of its patents (21 of them with Android-based phones, the remaining three with set-top boxes and DVRs), while Motorola previously asserted 18 patents against a variety of Apple products (mostly but not exclusively iPhone, iPad and iPod). Litigation between the two companies has taken place in several different federal courts.
In November 2010 Apple sued Motorola, alleging that the company's smartphone lineup and the...

Those figures are a little different for iPhone purchases at Best Buy, where AT&T tallies 60%, Verizon 21% and Sprint 19%. At other retail outlets, those figures are 55%, 275 and 18%, respectively. CIRP surveyed iPhone buyers over two three-month periods, ending March and May 2012.
Mac users prefer more expensive hotel rooms than Windows users
Orbitz (http://www.orbitz.com/), the travel shopping site Orbitz, offers more expensive hotels to Mac users because the company found Mac users prefer more luxurious rooms, according to "The Wall Street Journal" (http://macte.ch/AI1DI).
Mac users spend as much as 30% more a night on hotels, so the online travel agency is starting to show them different, and sometimes costlier, travel options than Windows visitors see, the article adds. Orbitz executives confirmed to "The Journal" that the company is experimenting with showing different hotel offers to Mac and PC users.

Ebook price-fixing lawsuit to go to trial June 2013
The Justice Department’s price-fixing lawsuit against e-book publishers and Apple will go to trial in June 2013, reports "The Washington Post" (http://macte.ch/aIipV). Apple has maintained that it did no wrong and argued to a federal judge last Friday that it wants a speedy trial to defend itself, the article adds.
U.S. Judge Denise Cote set the beginning of trial at June 3, 2013. The Justice Department had requested for the trial to begin near the end of 2013, reports "The Washington Post."
In April the United States Department of Justice filed an antitrust lawsuit against Apple, Hachette SA, HarperCollins, Macmillan, Penguin and Simon & Schuster in New York district court, claiming collusion over eBook pricing. Apple and Macmillan, which have refused to engage in settlement talks with the Justice Department, deny they colluded to raise prices for digital books. The companies argue that pricing agreements between Apple and publishers enhanced competition in the e-book industry,...
eBizcuss employees sue Apple
Another day, another lawsuit. Or 75 to be exact. Apple has been sued 75 times ass former employees of reseller eBizcuss filed individual suits against the iPhone-maker in Paris, reports "The Channel" (http://macte.ch/wIF1J).
eBizcuss was the biggest reseller of Apple products in France until the end of May, when the firm went into administration. In December the eBizcuss CEO Francois Prudent claimed that the financial woes of the reseller were a direct result of Apple's business practices.
In 2011, he filed a lawsuit against Apple. Prudent said his 16 locations in France suffered a 30% decline in business during the third quarter of 2011 after the supply of iPad 2 and MacBook Air laptops from Apple dried up.
In the fourth quarter, eBizcuss couldn't obtain a supply of the iPhone 4s, he added. Prudent said his company's product shortages started in November 2009 when the Apple opened its first retail store in France.
However, the suit was invalidated when eBizcuss went under. Now the...
Analyst doesn't have much hope for Microsoft's Surface...
In a note to clients -- as noted by "AppleInsider" (http://www.appleinsider.com) -- Deutsche Bank analyst Chris Whitmore doesn't hold out much hope for the success of Microsoft's Surface tablets.
His opinion: Microsoft is "grasping at a competitive response." Whitman thinks that response will fall short of competing directly with the iPad.
The analyst feels Microsoft has a "major dilemma" in how it will price its Surface tablets. For the low-end ARM models running Windows RT, Whitman believes Microsoft will have to undercut the iPad on price to find any success. However, this, in turn, could make it impossible for Microsoft's Windows partners to compete.
The analyst estimates that those partners will have to price their Windows RT tablets at around US$650 to generate gross margins of about 20%. However, if Microsoft were to compete with the iPad on price, it would "collapse the PC OEM [original equipment manufacturer] profit pool," he said.
East Alton school implementing iPad initiative
The East Alton (Illinois) Elementary School Board has moved forward with a plan to implement a One to One iPad initiative and approved a lease-to-purchase agreemen, reports "The Telegraph" (http://macte.ch/SFTB1).
“We’ll be leasing them directly from Apple,” Superintendent Virgil Moore says “At the end of the four-year lease, we will be able to buy the iPads for US$1 apiece.”
Required by the agreement to lease in bundles of 10 machines, the district plans to order 650 iPads for student use, notes "The Telegraph." An additional 70 MacBook Air laptops will be ordered for teachers to be able to write lessons that can be transferred to the students’ iPads, the article adds. Moore says the cost of the lease payment will be $129,000 per year.
Upcoming iOS Maps app to offer Yelp integration
Apple's upcoming iOS Maps app will include Yelp's "check in" feature to let users broadcast their whereabouts to friends, according to a "Bloomberg" report (http://macte.ch/Er08l).
Basing his on materials Apple distributed to software developers, Apple Maps, which will replace Google Maps as the default location service in iOS 6 later this year, will allow users to communicate through Yelp (http://www.yelp.com) without exiting the map and opening a new app, the article adds.
Yelp is a website that lets users review businesses of all sorts. It introduced a check-in service for mobile phones in 2010 in an effort to help local merchants build loyalty with regular customers. Integration with Apple Maps may help Yelp challenge Foursquare Labs and Facebook, two leading providers of check-in services, according to "Bloomberg."
Apple creates 35,852 retail jobs in the past five years
In the five years since the iPhone launched, Apple has created a total of 35,852 retail jobs, reports "asymco" (http://macte.ch/lKukz).
Some of those jobs came from new store openings, the article adds. The total store count went from 172 to 361, more than doubling. However, the growth in employment was faster: from about 6400 to 42,200, more than quintupling, notes "asymco." This is reflected in the total number of employees per store which increased from 37 in the first quarter of 2007 to 117 in the first quarter of 2012.
Apple vs. Motorola case dismissed
Apple can no longer pursue an injunction against Motorola Mobility, after a US judge dismissed the iPhone maker's smartphone patents lawsuit, reports the "BBC" (http://macte.ch/J5rcy).
Judge Richard Posner ended the case "with prejudice" between the firms, meaning that neither can re-file the suit, the article adds. However, an appeal is possible.

Acer founder: Microsoft will stop making tablets soon
Microsoft just announced its line of Surface tablets this week, but Acer founder Stan Shih says the Redmond firm will stop making them soon, reports "FOX News" (http://macte.ch/rs97z). He says the Windows maker "has no real intention to sell own-brand tablet PCs,"
"Microsoft hopes that marketing its own-brand tablet PCs will encourage vendors to offer Windows 8 tablet PCs and thereby help expand market demand for the product line," Shih says. "Once the purpose is realized, Microsoft will not offer more models."
I suspect the Surface line of tablets won't be around for too long, either. However, I have a feeling it will be for other reasons than Shih suggests. In other words, the Surface may well come to the same "too little, too late" end as Microsoft's Zune media player and Kin phone.

Analyst: we may see an 'iTV" by Christmas
In a note to clients -- as reported by "Forbes" (http://macte.ch/cT6hF) -- Topeka Capital Markets analyst Brian White says contract manufacturer Hon Hai expects to start receiving LCD TV panels from Sharp in the third quarter rather than the fourth quarter and thinks this may hint at an Apple HDTV (the rumored "iTV") by Christmas.
Hon Hai had invested in Sharp earlier this year to secure LCD panels that he thinks is meant for the Apple television. The analyst also thinks that Apple plans to use "
a special type of motion detection technology on the future full blown Apple TV," rather than touch technology."
"Contacts indicate a unique remote control with a touch panel form factor that looks similar to the iPad would be used to control the device," White says. "The bezel is expected to be a plastic composition, rather than the aluminum unibody exterior that surrounds the MacBook Air."
Judge approves fine for 4G iPad ads
An Australian judge has approved a $2.25 million fine against Apple for misleading consumers with advertising for its 4G iPad, reports "CNET."
The settlement, which was proposed and approved by Apple two weeks ago, puts to rest a lawsuit brought by the Australian Competition and Consumer Commission (ACCC) in March that accused Apple of violating the country's consumer law by misleadingly labeling its new iPad as 4G-capable. While the branding on the device specifically said "Wi-Fi + 4G," there aren't any 4G networks compatible with the device in Australia.
The Australian Competition and Consumer Commission, the country's consumer watchdog had taken Apple to court for false advertising because the tablet computer doesn't work on Australia's 4G network. Apple's lawyers said they were willing to publish a clarification, but said the company didn't mislead customers. On its website, Apple did state that 4G LTE is only supported on selected networks in the US and Canada.
