Court denies two Samsung motions
As reported by "FOSS Patents" (http://macte.ch/uwORu), the United States Court of Appeals for the Federal Circuit today denied two Samsung motions relating to the preliminary injunction Apple won against the Galaxy Tab 10.1 four weeks ago. The court: ° Denied Samsung's motion to stay the preliminary injunction for the duration of the appellate proceedings. ° Denied a Samsung motion to expedite the appeal. In May Apple filed a motion for a U.S. preliminary injunction against Samsung's Galaxy Tab 10.1. The motion is based on a ruling by the Court of Appeals for the Federal Circuit (CAFC), which came down in May and sided with Apple on the question of whether an iPad-related design patent (U.S. Patent No. D504,889) is likely valid.

Senator sides with Apple in ebook brouhaha
Sen. Charles Schumer (D-NY) has appealed to the U.S. Justice Department to drop its antitrust lawsuit against Apple and certain book publishers through an op-ed in "The Wall Street Journal," saying it will result in restoring Amazon to the “dominant position atop the e-books market," reports the "Wall Street Cheat Sheet" (http://macte.ch/vjOYP). In April the United States Department of Justice filed an antitrust lawsuit against Apple, Hachette SA, HarperCollins, Macmillan, Penguin and Simon & Schuster in New York district court, claiming collusion over ebook pricing. Apple and Macmillan, which have refused to engage in settlement talks with the Justice Department, deny they colluded to raise prices for digital books. Apple to build second, smaller data center in Maiden, N.C.
Apple's data center in Maiden, N.C., will be accompanied by a second, smaller data center, reports the "Winston-Salem Journal" (http://macte.ch/oICBR). According to Apple’s design plans on file with Catawba County, the new 21,030-square-foot data center, also referred to as a “tactical” data center, will store clusters of servers. Permits filed with the county list the cost of the new 11-room data center at $1,885,129, notes the "Journal." The article adds that an electrical permit on file refers to the building as a “non-occupied equipment building." Rick Frady, building services chief for Catawba County, told the "Journal" that a non-occupied building just means it’s not open to the public. He said the future building was described to him as a stand-alone metal building with a concrete pad. Judge bars Jobs' anti-Samsung statements in trial
U.S. judge has approved Apple's request to bar disparaging statements by the late Steve Jobs about Google's Android operating system from an upcoming patent trial against Samsung, reports "Reuters" (http://macte.ch/x7qUz). The late Apple CEO blasted Samsung's intellectual property procedures several times. He even said he was willing to go "thermonuclear" to "destroy" the Google operating system used in many mobile Samsung devices. Samsung wanted to introduce Jobs' statements in court as they "speak to Apple's bias, improper motives and its lack of belief in its own claims in that they are a means to an end, namely the destruction of Android." However, Apple argued that Jobs' quotes are an inadmissible distraction, and asked that they be barred from trial. Verizon iPhone sales dip in second fiscal quarter
Verizon (http://www.verizon.com) has announced its second quarter fiscal report. The telecom reported a second consecutive quarter of double-digit percentage growth in year-over-year earnings results and significant increases in operating cash flow. Verizon sold 2.7 million iPhone for the quarter, down from 3.2 million in the previous quarter. Verizon Wireless generated record-high margins and strong operational results, and Verizon's Wireline segment generated continued increases in revenues from FiOS fiber-optic services and strategic business services. Verizon reported US$0.64 in EPS [earnings per share] in second-quarter 2012, an increase of 12.3% compared with second-quarter 2011 earnings of $0.57 per share.  In second-quarter 2012, Verizon's total operating revenues were $28.6 billion on a consolidated basis, an increase of 3.7% compared with second-quarter 2011. E-book sales double from 2010 to 2011
Sales of e-books more than doubled from 2010 to 2011, according to a survey of nearly 2,000 publishers by the Book Industry Study Group, a research organization, and the Association of American Publishers. E-books jumped from 6% of the market to 15 % and e-revenue for new adult fiction is now higher than the revenue for hardcovers, notes the "Associated Press" (http://macte.ch/f5yNo). Sales for books overall dropped 2.5% to $27.2 billion and 12.6% at physical stores, thanks in part to the fall of the Borders superstore chain, the article adds.

Samsung ships Smart Camera MV900F

Skycore launches mobile-optimized email platform

Intel reports second quarter revenue of $13.5 billion
Intel (http://www.intel.com) has reported quarterly revenue of US$13.5 billion, operating income of $3.8 billion, net income of $2.8 billion and earnings per share of $0.54. The company generated approximately $4.7 billion in cash from operations, paid dividends of $1.1 billion and used $1.1 billion to repurchase stock. "The second quarter was highlighted by solid execution with continued strength in the data center and multiple product introductions in ultrabooks and smartphones," says Paul Otellini, Intel president and CEO. "As we enter the third quarter, our growth will be slower than we anticipated due to a more challenging macroeconomic environment. With a rich mix of Ultrabook and Intel-based tablet and phone introductions in the second half, combined with the long-term investments we're making in our product and manufacturing areas, we are well positioned for this year and beyond."

USB 3.0 group announces power delivery spec
The USB 3.0 Promoter Group, in conjunction with the USB 2.0 Promoter Group, has announced the completion of the USB Power Delivery specification, which enables increased power delivery through USB cables and connectors. The specification expands cable bus power capabilities in USB applications, supplying higher voltage and current to deliver power up to 100 watts over USB Power Delivery certified cables. It's capable of delivering higher power to charge notebook computers and power external hard-disk drives, devices which previously did not receive adequate power from traditional 5V bus power, according to Brad Saunders, USB 3.0 Promoter Group chairman. Here are the latest updates for Mac OS X apps: Mozilla Firefox has been revved to version 14.0.1. The upgrade of the web browser sports new security features and vulnerability patches. Zevrix Solutions (http://zevrix.com) has released LinkOptimizer 4.7.2, an update of its workflow automation solution for Adobe InDesign. The new version is prepared for distribution on Adobe Exchange. Handbrake (http://handbrake.fr/downloads.php), a DVD "ripping" app for Mac OS X, has been updated to version 0.9.8. It's a maintenance release with some bug fixes. Houdah Software (http://www.houdah.com/) has updated HoudahSpot, their Spotlight front end for Mac OS X, to version 3.5.5. The upgrade is now signed with a Developer ID certificate for Gatekeeper compatibility. Apple posts MacBook Air, MacBook Pro updates
Apple has posted MacBook Air and MacBook Pro Update 1.0. You can obtain them via the Software Updates component of the Mac OS X Systems Preferences app. According to Apple, the update fixes a problem with “increased CPU power consumption” and “improves compatibility with some USB devices.” Apple recommends the update for the new MacBook Pro and MacBook Air models, including the new Retina MacBook Pro.

Judge: Apple must acknowledge Samsung didn't copy the iPad
A British judge has ordered Apple to publish a notice on its U.K. website and in British newspapers alerting people to a ruling that Samsung didn’t copy designs for the iPad, reports "Bloomberg." The notice should outline the July 9 London court decision that Samsung’s Galaxy tablets don’t infringe Apple’s registered designs, Judge Colin Birss said. It should be posted on Apple’s U.K. home page for six months and published in several newspapers and magazines to correct any impression Samung was copying Apple’s product, the judge added. "Bloomberg" says the order means Apple will have to publish “an advertisement” for Samsung, Richard Hacon, a lawyer the company, told the court. “No company likes to refer to a rival on its website," he said. A U.S. judge has rejected several requests by Apple and Samsung to keep portions of key documents out of public view in their patent litigation battle set for trial later this month, reports "Reuters" (http://macte.ch/JpN4g). In an order issued on Tuesday, U.S. District Judge Lucy Koh in San Jose, California, wrote that "it appears that the parties have over-designated confidential documents and are seeking to seal information that is not truly sealable." Portuguese Association plans Apple lawsuit
The Portuguese Association for Consumer Protection (DECO) says it's moving forward with a lawsuit against Apple over information provided on the company's website that allegedly misleads buyers into purchasing the add-on AppleCare Protection Plan. In a statement first reported by Portuguese language Apple blog "iPhoneTuga" -- and translated by "AppleInsider" (http://www.appleinsider.com), the non-profit DECO claimed the potential suit comes after "several attempts" to correct allegedly deceptive wording on the iPhone maker's website pertaining to the for-pay AppleCare Protection Plan. This is similar to the situation in Italy in which Apple was fined US$1.2 million for "unfair consumer practices." The Italian Antitrust Authority claimed Apple did not provide "clear information to customers on product assistance." Apple moves forward on Austin campus plans
Apple is moving forward on its plans to bring 3,600 new jobs and invest more than US$300 million in Austin, Texas. Records at the Travis County Clerk’s Office show that McShane Development Co. LLC, through its Riata Vista LP entity, sold three tracts of land to Apple on June 20, reports "The Austin Business Journal" (http://macte.ch/mPcK6). The exhibits indicate that the land is in the Milwood Section 20 subdivision near Parmer Lane and Delcour Drive. There's no info on how much Apple paid for the property. Earlier this year Texas Gov. HTC brings infringement counterclaims against Apple
HTC today brought infringement counterclaims against Apple in the Southern District of Florida over two patents it acquired from HP last December, reports "FOSS Patents" (http://macte.ch/OHzjP). "The litigation in which the Taiwanese device maker is asserting those two patents is a case that started in 2010 with a Motorola lawsuit against Apple, which later became consolidated with another action in the same district," Florian Mueller writes for "FOSS Patents. "Six of Apple's twelve infringement counterclaims in that consolidated action target not only Motorola Mobility but also HTC. HTC wants the case moved out of Miami, but its motion to transfer is still pending. In the meantime, HTC had to respond to Apple's counterclaims. Mac sales grew 1% year-over-year in June
According to the latest data from NPD (http://www.npd.com) -- as reported by "AllThingsD" (http://macte.ch/gn5Zl), Mac sales grew 1% year-over-year for the last month of the June quarter, after falling 13% in April and 23 percent in May. For the full fiscal quarter, Mac sales are still down 10 percent from the same period a year ago. However, the fact that they’ve recovered from that 23% decline in May "is a positive sign as we head into fall and the uptick in consumer spending that it heralds," the article adds. "We believe the momentum from the June Mac refresh will carry into the September quarter," says Piper Jaffray analyst Gene Munster, who published NPD’s sales data in a research note. "While the up 1% is not tremendous growth, we believe that the refreshed Macs will enable Apple to sustain a better growth profile in the U.S. through the back-to-school season." He expects Mac growth of 5% for the June quarter. Munster predicts that Apple will ship 4.1 million Macs.

Survey: 65% of cell phone users plane to buy an iPhone next
In a note to clients -- as reported by "Fortune" -- Piper Jaffray's Gene Munster reported the results of his annual cell phone survey. Among the key points: ° Asked what phone they were going to buy next, 65% said an iPhone, 19% said a Google Android, 6.5% said "not a smartphone," 6% said "I don't know," and 2.5% said a Research in Motion Blackberry. ° Fifty-one percent of respondents who planned on making the iPhone their next smartphone (whether current iPhone users or not) said they were waiting for the next gen iPhone. ° 94.2% of iPhone users plan to buy an iPhone for their next phone, improving upon last year's rate of 93%. FontXChange 4.0 for OS X gets new font properties window
FontGear has released FontXChange 4.0 for Mac OS X and Windows. It's an update of the font conversion application that converts fonts between common font formats. Former iAd head joins motion-control company
Leap Motion (http://leapmotion.com/), a motion-control software and hardware company, has announced the appointment of Andy Miller as president and chief operating officer. German court: Xoom doesn't infringe on iPad patents
A German court has ruled that Motorola Mobility's Xoom tablet doesn't infringe on Apple's iPad design, but rejected a claim by Motorola that the Apple tablet patent is invalid, reports "Dow Jones" (http://macte.ch/f7GgU). This is part of an ongoing battle between the two companies. Apple has previously alleged that Motorola infringes 24 of its patents (21 of them with Android-based phones, the remaining three with set-top boxes and DVRs), while Motorola previously asserted 18 patents against a variety of Apple products (mostly but not exclusively iPhone, iPad and iPod). Former Apple Exec joins Parallels board of directors
Parallels (http://www.parallels.com), which specializes in cloud services enablement and desktop virtualization software, has announced the appointment of Betrand Serlet, former senior vice president of software engineering at Apple, to its board of directors. Average iPhone user values handset more than average Android...
A new survey by the Piper Jaffray research group -- as reported by "AppleInsider" (http://www.appleinsider.com) -- says that average iPhone user considers their handset to be worth US$313 to them, while Android smartphones are valued at $220. The investment firm polled more than 400 consumers from around the U.S. and Asia in its annual cell phone survey. The surveys were conducted in larger cities and over half of users being iPhone owners. Piper Jaffray asked participants to come up with a dollar value for how much their current phone is worth to them. The survey found that among the 208 current iPhone users, the average value was $313, which is over $100 more than the subsidized price of the 16-gigabyte iPhone 4S, notes "AppleInsider." On the other hand, users of Android handsets said their current smartphone was worth $220 on average, while BlackBerry smartphone owners pegged the value of their device at $219.

Qantas airlines replacing Blackberries with iPhones
Qantas airlines will replace 1300 BlackBerry phones used by employees with iPhones, according to the "Sydney Morning Herald" (http://macte.ch/MpgsL). The switch was made after the majority of respondents to a recent staff survey indicated their preference for Apple's device over the "increasingly unpopular BlackBerry," the article adds. "The iPhone offers a user-friendly interface and simple access to emails, contacts and calendars, as well as meeting all Qantas' security requirements," a Qantas spokesman told the "Herald." Qantas said the move to iPhone could save the company millions of dollars due to better carrier arrangements for mobile data from both Telstra and Optus, as well as simplified support infrastructure.

RESTfm provides web services for FileMaker databases
FileMaker solutions provider, Goya Pty (http://www.goya.com.au/), has announced their new web services product, RESTfm. It turns your FileMaker Server into a RESTful web service, so you can access your FileMaker Server databases via the web using a common REST architecture. RESTfm supports full Create, Read, Update and Delete ( CRUD ) operations on FileMaker Server hosted data via standard HTTP GET, POST, PUT and DELETE methods, according to Nicholas Orr of Goya Pty. It allows developers to build web-based systems that interact in simple standard ways with FileMaker Server, he adds. However, it also allows other FileMaker platforms like FileMaker Pro or FileMaker Go clients to talk back to FileMaker Server via the web instead of needing to open special ports for access. RESTfm is available for US$399 for a single FileMaker server license. Other licensing options, education and not for profit pricing is available on request.

It's an US$34.95 "lite" version of the company's fully featured file system events monitor, FSE. Scannerz is designed to detect problems and help users isolate their actual problems before attempting a repair. Ableton releases Electrix partner instrument
Ableton, in conjunction with Sample Logic, presents Electrix (http://www.ableton.com/library/electrix), an US$99 collection of instruments derived from real-world acoustic sample material, synthesis and physical modeling. Sonically, the toolkit combines the cinematic sound design of animated atmospheres, morphed instruments and electrified percussion with varieties of cutting leads, growling basses, and tempo-synced audio loops. Within Ableton Live, Electrix is sorted into five sections containing 311 instruments and 75 audio loops. Each instrument uses Live's Rack format, with macro controls mapped to filter, envelope and effects parameters. This allows for customization and spontaneous tweaking during a performance.
